ORDINANCE N0.2008-19 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING AN AMENDMENT TO THE FUTURE <br />LAND USE MAP FROM MEDIUM DENSITY <br />RESIDENTIAL/COMMERCIAL (MDR/C) TO COMMERCIAL (C) FOR LOT <br />2 OF THE GARY FARM SUBDIVISION, AN APPROXIMATELY 10.86 <br />ACRE TRACT OF LAND, LOCATED IN THE 2400 BLOCK OF N IH-35; <br />AND AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY <br />REZONING THIS TRACT FROM SINGLE FAMILY RESIDENTIAL <br />DISTRICT/FUTURE DEVELOPMENT (SF-6/FD) TO COMMUNITY <br />COMMERCIAL (CC) ;INCLUDING PROCEDURAL PROVISIONS. <br />RECITALS <br />1. On March 25, 2008 the City Planning and Zoning Commission of the City of San <br />Marcos held public hearings regarding a request to change the Future Land Use Map of the San <br />Marcos Horizons City Master Plan from Medium Density Residential/Commercial (MDR/C) to <br />Commercial (C) and a concurrent request to change the zoning from Single-Family Residential <br />District/Future Development (SF-6/FD) to Community Commercial (CC) fora 10.86 acre, more <br />or less, tract of land located in the 2400 block of N IH-35 and legally described as Lot 2, Gary <br />Farms Subdivision recorded in Book 10, Page 168 of the Hays County Plat Records. <br />2. Subsequent to the public hearings on that date, the Planning and Zoning Commission <br />considered and voted to approve the requests and recommended that the requests be approved by <br />the City Council. <br />3. The City Council held a public hearing on April 15, 2008 regarding the requests. <br />4. All requirements of Chapter 1, Development Procedures, of the City Land <br />Development Code pertaining to Future Land Use Map Amendments and Zoning Map <br />amendments have been met. <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. The Future Land Use Plan of the San Marcos Horizons City Master Plan is <br />revised to change the future land use designation from Medium Density Residential/Commercial <br />(MDR/C) to Commercial (C). <br />Street address: 2400 Block of N IH-35 <br />Size: 10.86 acres, more or less. <br />
