RECITALS: ORDINANCE 2004- 2 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY ZONING A 21.374 ACRE, MORE OR LESS, TRACT OF LAND, LOCATED IN THE 3000 BLOCK OF IH-35 NORTH AS "C" COMMERCIAL DISTRICT AND ZONING A 6.109 ACRE, MORE OR LESS, TRACT OF LAND LOCATED OFF OF THE 3000 BLOCK OF IH-35 NORTH AS "LI" LIGHT INDUSTRIAL DISTRICT; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. 1. On November 25, 2003, the Planning and Zoning Commission of the City of San Marcos held a public hearing regarding a request to establish the zoning for a 21.374 acre, more or less, tract of land in the 3000 Block of IH-35 North as "C" Commercial District, and to establish the zoning for a 6.109 acre, more or less, tract of land located off of the 3000 Block of IH-35 North as "LI" Light Industrial District. 2. Subsequent to the public hearing on that date, the Planning and Zoning Commission did, on November 25~ 2003 consider and vote to approve the request, and has recommended that the request be approved by the City Council of the City. 3. The City Council held a public hearing on the 12th day of January 2004.,regarding the request. 4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining to zoning map amendments have been met. 5. The City Council hereby finds and determines that the ad9ption of the following ordinance is in the interest of the public health, morals, welfare and safety. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 of the San Marcos City Code, is amended to establish the zoning for the following real property as "C" Commercial District: Street address: 3000 Block of IH~35 North. Legal description: A 21.374 acre, more or less, tract out of the William Ward Survey, Number 3, Abstract 467, a metes and bounds description of which is attached as Exhibit A.
