ORDINANCE NO. 2004- 5 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAI~ MARCOS, TEXAS, AMENDING ARTICLE 11, <br />LICENSING OF BUILDING CONTRACTORS, OF <br />CHAPTER 14, BUILDINGS AND BUILDING <br />REGULATIONS, OF THE SAN MARCOS CITY CODE, TO <br />REVISE AND CLARIFY BUILDING CONTRACTOR <br />LICENSING REGULATIONS; INCLUDING PROCEDURAL <br />PROVISIONS; AND DECLARING AN EMERGENCY. <br /> <br />1_52 <br /> <br />RECITALS: <br /> <br /> 1. The City Council regulations for building contractors to help ensure quality <br />construction and construction code compliance for residences and businesses, <br /> <br /> 2. The experience of the city staff and the concerns of the building industry have <br />indicated the need for certain changes to the contractor licensing regulations, including <br />a) providing for exemptions from testing requirements, and b) providing for testing to be <br />performed by an independent agency rather than by the City's building official. <br /> <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br /> SECTION 1. Section 14.009 of the San Marcos City Code is amended as follows <br />(underlining indicates added text, ~ indicates deleted text): <br /> <br />Sec. 14.009. Certificate of insurance required for contractors. <br /> <br />(a) A licensed builder performing construction work in the city shall provide the <br />inspection division a certificate of insurance that meets the requirements of <br />subsection (b) of this section. The building inspections division will not issue a <br />license until it receives the certificate of insurance. <br /> <br />(b) A certificate of insurance shall: <br /> <br />(1) be written by a company licensed to do business in the State of Texas; <br /> <br /> (2) provide for commercial general liability insurance coverage for the <br />builder for claims for property damage or bodily injury; and <br /> <br /> (3) be in a coverage amount of not less than $300,000 for all claims, <br />includinq products and completed operations, arising in any one year period. <br /> <br />(c) This article and article 12 of this chapter do not alter the responsibility of any <br />person performing any construction activity for damages to anyone or for <br /> <br /> <br />
