Williams <br />Director, Public Works William Friedrich <br /> <br />Absent <br /> <br />Councilman <br /> <br />Ted Breihan <br /> <br />Also present: Mr. & Mrs. Richard Mason; Gerald Klossner; Jose Villarreal; <br />Simon Ramirez, jr.; Col. Jim Hill; Peggy Mayberry; Mrs. Kay <br />Burton; John Morrisset; J.R. Molina; Leo Poore; Jerri Martin; <br />Melissa Millecam; Terry Roberts; and others. <br /> <br />The Mayor called the meeting to order at 6:00 p.m. <br /> <br />Councilman Sutton moved to recess to Executive Session to discuss a personnel <br />matter. Councilman Hansen seconded the motion, which passed unanimously. <br /> <br />I <br /> <br />The Council reconvened in Regular Session at 7:30 p.m. <br /> <br />The Mayor reported that personnel matters and procedures had been discussed <br />in the Executive Session, and reported that the City Manager would hold a <br />press conference at 11:15 a.m., June 25, 1974, at City Hall to discuss the <br />matter further. <br /> <br />The Minutes of the Regular Meeting held June 10, 1974, were approved on <br />motion of Mr. Sutton and second of Mr. Hansen. <br /> <br />Mayor Craddock opened a Public Hearing to consider a request for a change <br />in zoning of property located at 1105 Highway 123 from "c" to "C-2". Attorney <br />Gerald Klossner was present to represent the applicant, Richard Mason. <br />Mr. Klossner stated the contentions that "C-2" zoning represented the highest <br />and best use of the property, that the legislature had not given adjacent <br />property owners absolute control over zoning matters, and that the matter of <br />consumption and sale of alcoholic beverages was not the issue. Jose Villarreal <br />and Simon Ramirez, Jr., property owners within 200 feet of the property in <br />question came forward to object to the zoning change. The Mayor closed the <br />hearing and read the caption of an ordinance as follows: <br /> <br />I <br /> <br />AN ORDINANCE AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES <br />AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND <br />LAND, DATED MAY 23, 1966 (VOL. 32) BY CHANGING THE ZONING OF .71 <br />AND .703 ACRES OF LAND OUT OF THE J.M. VERAMENDI LEAGUE NUMBER ONE, <br />LOCATED AT 1105 HIGHWAY l23, FROM "c" (COMMERCIAL) TO "C-2" (COMMERCIAL). <br /> <br />Mr. Sutton moved the Ordinance not be approved. Mr. Flores seconded the <br />motion. It was noted that the Planning and Zoning Connnission had recommended <br />denial of the request, and that a petition signed by more than 20% of property <br />owners in objection to the change (see Mason zoning file) had been received. <br />On roll call, the following vote was recorded: <br /> <br />AYE: Dibrell, Craddock, Flores, Hansen, Sutton <br />NAY: Cunningham. <br /> <br />The Mayor declared the motion passed and the Ordinance not approved. <br />
