M. Allen presiding.

Present: Mayor C. M. Allen
Alderman: S. R. Beecroft
W. M. Davis
B. D. Hillburn
Herman Korff
James Tuttle
City Manager B. R. Fuller
City Secretary Judy Brackett
Walter Buckner - San Marcos Record
Miss Lillian Barclay - AAUW

The Tax Assessor-Collector reported that an improper
assessment had been made in the tax year 1958 against Victor
Vargas on Lot in J. Veramendi League. This was paid on
January 15, 1959 and a refund in the amount of $25.00 is due.
Alderman Hillburn moved that the refund be approved, which
was seconded by Alderman Korff and carried.

Mr. R. L. Hyatt who leases the grazing land at the Sewage
Disposal Plant reported to the City Manager that he feels he
was adversely effected because of interruption in the use of
the land during construction of force main and has requested a
20% reduction in the yearly rent. (From $125.00 to $100.00).
This lease will be subject to removal on December 31, 1960.
Alderman Hillburn made the motion that the reduction of $25.00
be allowed for the year 1960 and that ~~. Hyatt be notified that,
as the City plans to use the entire area at the end of the
present lease, the land will not be available for lease after
December 31, 1960; Alderman Korff seconded the motion which
carried unanimously.

Alderman Tuttle made the motion that the City request
bids for 10 tables, 40 chairs, 1 table truck and 1 chair truck
at an estimated cost of $491.00 for use at the City Park. Of
this amount, $301.73 is available in the Park Construction
Fund and the balance to be paid from the General Fund. Alder-
man Davis seconded, motion carried. The City Manager was
directed to advertise for bids on this purChase.

The City Manager reported that Rauscher Pierce & Company,
Inc. are offering 5 of the City's 1956 Street Improvement
Bonds for sale. After some discussion on the advisability of
the city's purchasing these, the matter was postponed.

On August 11, 1959, the matter of payment of delinquent
taxe? by a Mr. J. F. Thompson was considered. It seems that
in November, 1953, Ww. Thompson paid twelve years delinquent
taxes on property he owns. Three years, viz., 1942, 1943,
and 1944 were left unpaid. Mr. Thompson maintains that he
planned to pay all taxes due. On August 11, 1959, the Council
referred the matter to the delinquent tax attorney who has
made the following reconnnendation: "considering all of the
circumstances of his previous payment, the most equitable way
to handle the matter would be to require him to pay the delin-
quent taxes due for the years 1942, 1943 and 1944 at the same
amount of penalty and interest that would have been due in
November of 1953."
