ADJOURNED REGULAR MEETING HELD ON SEPTEMBER 21. 1960 On the 21st day of September, 1960, at 3:00 o'clock P.M., the Governin9 Body of the City of San Marcos met in adjourned regular session, Mayor C. M. Allen presiding. I Present: Mayor C. M. Allen Aldermen: ~. R. Beecroft W. M. Davis B. D. Hillburn Herman Korff James Tuttle City Manager B. R.Fuller City ~ecretary Judy Brackett Also Present: Mrs. Roland Manske, MUW Mr. R. L. Hyatt Mrs. E. O. Bethke, Record The meeting was called to order by the Mayor. The regular order of business was dispensed with to hear Mr. R. L. Hyatt. Mr. Hyatt asked that the City lease him the small field of the Sewage Disposal tract next to his house. He had been leasing all the land at the Sewage Disposal Plant, but by letter dated February 11, 1960, Mr. Hyatt was notified that the lease would not be renewed for 1961. It was the unanimous decision of the Council that no lease be made, as the City has plans for the use of the property (~ee Volume 23, Page 172). I The City Manager presented a tabulation of the bids received and opened on September 12th for a police patrol car and an admin- istrative car. After a review of the bids received, Alderman Korff moved that the bid of the Allen Motor Company for Item One, 1961 Dodge "~eneca Police Special", in the net amount of $1,880.00 be accepted. This motion was seconded by Alderman Tuttle and, upon roll call,the motion carried. No action was taken on the purchase of an administrative vehicle. Alderman Hillburn introduced an ordinance and moved its adoption. The ordinance entitled: AN ORDINANCE MAKING IT UNLAWFUL TO USE A SPEAR GUN AS A MEANS OF SHOOTING OR TAKING FISH, OR ATTEMPTING TO SHOOT OR TAKE FISH, FROM THE SAN MARCOS RIVER WITHIN THE CORPORATE LIMIT~ OF THE CITY OF SAN MARCOS, MAKING IT UNLAWFUL TO DISCHARGE A ~PEAR GUN IN OR INTO THE SAN MARCOS RIVER; MAKE THE POSSESSION OF A SPEAR GUN IN THE SAN MARCO::; RIVER PRIMA FACIE EVIDENCE THAT SUCH ~PEAR GUN IS BEING USED AS A MEANS OF SHOOTING OR TAKING OF FISH; PROVIDING THAT ALL PERSONS PARTICIPATING IN OR AIDING OR ABETTING OR ASSISTING IN THE VIOLATION OF THIS ORDINANCE SHALL BE GUILTY AS PRINCIPALS; DEFINING TERMti; CONTAINING SEVERALABILITY PROVISION; AND PROVIDING FOR PUNISHMENT I was read in full. The motion was seconded by Alderman Korff. Upon roll call the ayes and nayes were as follows: AYE~I Aldermen: Beecroft Davis Hillburn Korff Tuttle NAYE::, : None Whereupon the Mayor declared the ordinance passed, approved and adopted.
