RESOLUTION NO. ]981-11R A RESOLUTION OF THE CITY OOUNCIL OF THE CITY OF SAN MARCOS, TEXAS APPROVING A SETTLEMENT AGREEMENT IN THE APPLICATION OF LOWER COLORADO RIVER AUTHORITY FOR A RATE INCREASE, DOCKET NO. 3522 PENDING~ BEFORE THE PUBLIC UTILITY COM24ISSION On TEXAS; AUTHORIZING EXECUTION OF SAID SETTLEMENT AGREEMENT AND DECLARING AN EFFECTIVE DATE. WHEREAS, on October 31, 1980, Lower Colorado River Authority (LCRA) filed with the Public Utility Commission of Texas a state- ment of intent to increase rates for electric service effective December 5, 1980; and, WHEREAS, although the Commission has original jurisdiction only over the wholesale rates and the retail rates in unincorporated areas, the retail rates in incorporated areas were included in the rate filing package filed with the Commission; and, WHEREAS, the City of San Marcos, Texas has participated in the proceedings before the Commission numbered and enti~l, ed Docket 3522, The Application of Lower Colorado River Authority for a Rate Increase, through the appearance of Don Butler; and, WHEREAS, the City Council of the City of San Marcos, Texas wishes to approve the Settlement Agreement in Docket 3522 while fully preserving its rights of original jurisdiction under Section 17(a) of the Public Utility Regulatory Act, TEX.REV.CIV.STAT.ANN. art. 1446c (1980) to set rates for electric service within the corporate limits of the City of San Marcos; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. That the Settlement Agreement in Docket 3522, The Application of Lower Colorado River Authority For A Rate Increase, pending before the Public Utility Commission of Texas, a copy of which is attached hereto and incorporated herein, be, and the same is hereby, approved subject to the original jurisdiction of the City of San Marcos to set rates for electric service within the corporate limits of the City of San Marcos. PART 2. That Don Butler, attorney for the City of San Marcos in Docket 3522 be, and he is hereby, authorized to execute said Settlement Agreement on behalf of the City of San Marcos. PART 3. That a public hearing be set for 7:30 p.m., February 9, 1981, at City Hall, 630 E. Hopkins, San Marcos, Texas in the application, by LCRA for a rate increase for electric service within the corporate limits of the City of San Marcos, PART 4. That this resolution shall be in full force and effect immediately from and after its passage. ADOPTED this 26th day of January, 1981. · K~aus yor Attest: City Secretary
