<br />I <br /> <br />I <br /> <br />I <br /> <br />~~ 9 I <br /> <br />ORDINAN~E NO. 1978-5 <br /> <br />till ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />Still MARCOS, TEXAS, AMENDING ORDINANCE 1974-68, <br />AIXlPTED ON NOVEMBER 11, 1974, WHICH ESTABLISHED <br />till AIRPORT COMMISSION, DESIGNA.TED THE QUALIFICATIONS <br />OF THE COMMISSIONERS, AND OUTLINED THE POWERS AND <br />DUTIES OF THE COMMISSION, BY ENlARGING THE COMMISSION <br />FROM FIVE TO SEVEN MD1BERS; BY PROVIDING THAT THE <br />COMMISSION SHALL SIT AS till APPEAL HEARING BOARD; <br />BY ELll1INATING THE COMMISSION r S AUTHORITY TO CREATE <br />DEBTS OR ENTER IID'O CONTAACTS WITH APPROVAL BY THE <br />CITY COUNCIL; AND PROVIDING FOR till EFFECTIVE DATE. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />Part 1. That Section 31-3, entitled "Composition; Qualification and Appointrr,ents <br />of Members", of Article I, of Chapter 31 of the Code of Ordinances of the City <br />of San Marcos, Texas, which was adopted by Ordinance 1974-68 on November 11, 1974, <br />be, and is hereby amended by repealing the current said Section 31-3 and by <br />substituting in its place a new Section 31-3 to read as follows: <br /> <br />Section 31-3. Composition; qualifications and appointments of members. . <br /> <br />The Airport Corrmission shall consist of sevem members. One member of the <br />Commission JJE.y be a non-resident of the City of San Marcos; all other members <br />of the Corrmission shall be residents of the City of San Marcos. Membership <br />to the Commission shall be established by appointment by the City Council, and <br />appointments shall be made at the first regular meeting in, January. Members <br />shall serve for a period of two years, except that vacancies or newly created <br />positions shall be filled for the unexpired term to be filled. Terms of <br />membership shall be as follows: four members shall serve until the first <br />regular meeting of the City Council in January of even-numbered years, and <br />three members shall serve until the first regular meeting of the City Council <br />in January of Odd-numbered years. <br /> <br />Part 2. That Section 31-5, entitled "Appeal Hearing Board", of Article I, of <br />Chapter 31 of the Code of Ordinances of the City of San Miu'cos, Texas, which <br />was adopted by Ordinance 1974-68 on November 11, 1974, be, and is hereby, amended <br />be repealing the current said Section 3185 and by substituting in its place a new <br />Section 31-5 to read as follows: <br /> <br />Section 31-5. Appeal Hearing Board. <br /> <br />The Airport Commission, shall sit as an appeal hearing board in an effort to <br />assist in settling disputes and controversies concerning all fixed base operations, <br />and other lease arrangements held by individuals or business entities at <br />Municipal Airport. Tj).e Commission shall hav.e the power to hear the production <br />of evidence from the parties involved and to solicit evidence from the city <br />staff before rmking a recommendation to the City Council for the resolut:ion <br />of all disputes and controversies. Upon conducting a hearing in which aU in- <br />terested parties have had an opportunity to be hean:l, the Airport Commis:3ion <br />shall sul::mit to the City Manager, in writing, its findings and determinations, <br />accompanied by a recarnmendation for the final resolution of the matter. <br /> <br />Part 3. That Section 31-6, entitled "Limitations on Commission", Elf Article I, of <br />Chapter 31 of the Code of Ordinances of the City of San Marcos, Texas, which was <br />adopted by Ordinance 1974-68 on November 11, 1974, be, and is hereby, repealed. <br /> <br />Part 4. That Article I, entitled "Airport Canrnission," of Chapter 31, entitled <br />"Municipal Airport", of the Code of Ordinances of the City of San Marcos, Texas, <br />be, and is hereby, amended to add to said Article and Chapter of the Code two <br />sections to read as follows: <br /> <br />Section 31-6. Review of Lessees. <br /> <br />The Aii'port Commission shall have the responsibility to review all lessees at <br />San Marcos Municipal Airp:lrt and the applicable contracts for operations. <br />Said review shall result in an annual report being submitted by said AiJ:'port <br />Comnission to the City Manager and City Council. Such annual report shall be <br />submitted in February of each year and shall contain an appraisal of each <br />lessee's conformance in relation to respective leases. <br />
