99. ORDINANCE 2004 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS AMENDING CHAPTER 34, ENVIRONMENT, OF THE CITY CODE TO ADD PROCEDURES REGARDING DISPOSITION FOUND PROPERTY; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING AN EFFECTIVE DATE RECITALS: 1. The City Council finds that there exsts is a category of property that occasionaly comes into the custody of the Police Department that is not abandoned or seized, does not have any evidentiary purpose, and is not subject to any state or federal statutes with respect to disposition. 2. The Council wishes to establish a mechanism for disposition of 'this category of property and to allow the finders of the property to claim it when no owner can be determined. 3. The Council wishes to allow the police chief to develop reasonable procedures for attempting to determine ownership of found property. 4. An amendment to Chapter 34 of the City Code is necessary to establish procedures to dispose of found~property. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1: Section 34.151 of the City Code is amended to read as follows (underlining indicates new text): Sec. 34.151. Definitions. In this division: Abandoned personal property means any personal property other than a motor vehicle, left unattended on any public street, alley, sidewalk, park or any other property owned or controlled by the city. Found property means any property of undetermined ownership that has been found by a person and turned in to the custody of the police department or a police officer. Found property does not include narcotics, dangerous drugs or dru.q paraphernalia, contraband, property seized or impounded by any law enforcement entity, property, that consitutes evidence, abandoned personal property, property subject to disposition pursuant to state or federal statutes,
