99. <br /> <br /> ORDINANCE 2004 - <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS AMENDING CHAPTER 34, ENVIRONMENT, OF THE <br />CITY CODE TO ADD PROCEDURES REGARDING DISPOSITION <br />FOUND PROPERTY; INCLUDING PROCEDURAL PROVISIONS; AND <br />PROVIDING AN EFFECTIVE DATE <br /> <br />RECITALS: <br /> <br /> 1. The City Council finds that there exsts is a category of property that <br />occasionaly comes into the custody of the Police Department that is not abandoned or <br />seized, does not have any evidentiary purpose, and is not subject to any state or <br />federal statutes with respect to disposition. <br /> <br /> 2. The Council wishes to establish a mechanism for disposition of 'this <br />category of property and to allow the finders of the property to claim it when no owner <br />can be determined. <br /> <br /> 3. The Council wishes to allow the police chief to develop reasonable <br />procedures for attempting to determine ownership of found property. <br /> <br /> 4. An amendment to Chapter 34 of the City Code is necessary to establish <br />procedures to dispose of found~property. <br /> <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br /> SECTION 1: Section 34.151 of the City Code is amended to read as follows <br />(underlining indicates new text): <br /> <br />Sec. 34.151. Definitions. <br /> <br />In this division: <br /> <br /> Abandoned personal property means any personal property other than a <br />motor vehicle, left unattended on any public street, alley, sidewalk, park or any <br />other property owned or controlled by the city. <br /> <br /> Found property means any property of undetermined ownership that has <br />been found by a person and turned in to the custody of the police department or <br />a police officer. Found property does not include narcotics, dangerous drugs or <br />dru.q paraphernalia, contraband, property seized or impounded by any law <br />enforcement entity, property, that consitutes evidence, abandoned personal <br />property, property subject to disposition pursuant to state or federal statutes, <br /> <br /> <br />
