103. <br /> <br />ORDINANCE NO. 2004 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, AMENDING CHAPTER 106, <br />SIGNS, OF THE SAN MARCOS CITY CODE, TO REVISE <br />AND CLARIFY SIGN AREA AS IT APPLIES TO OFF- <br />PREMISES SIGNS; INCLUDING PROCEDURAL <br />PROVISIONS; AND DECLARING AN EMERGENCY. <br /> <br />RECITALS: <br /> <br /> 1. The City Council adopted Ordinance No. 2003-42 to establish a "cap and <br />replace" system for off premises signs under which a new sign can be constructed only <br />if the applicant first removes one or more existing off-premises signs with a total area <br />equal to or greater than the area proposed for the new sign. <br /> <br /> 2. Ordinance No. 2003-42 did not revise the definition of "area" for purposes of <br />the "cap and replace" system, with the result that the area of signs under the "cap and <br />replace" system was determined with reference to only one side of a multi-sided sign. <br /> <br /> 3. The City Council wishes to revise the City's sign regulations to clarify that its <br />intent in adopting the "cap and replace" system was to measure the area of signs under <br />that system with reference to all sides of the signs. <br /> <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br /> SECTION 1. Section 106.001 of the San Marcos City Code is amended as <br />follows (underlininq indicates added text, ~ indicates deleted text): <br /> <br />Sec. 106.001. Definitions. <br /> <br />Area means the largest area of a sign visible at any one time from any one point <br />and enclosed by a single continuous perimeter, including any framing or trim, but <br />not including any structural parts lying outside the limits of the sign and which do <br />not form an integral part of the display. If the copy of a sign is enclosed by a box, <br />outline or frame, the total area of the enclosure is the area. If the sign consists of <br />individual letters, numbers or symbols, on a surface or having no frame, the area <br />shall be measured as the sum of the areas of the smallest geometric figures <br />which can encompass each portion of the copy.
