<br />201 <br /> <br />ORDINANCE NO. 1977 - 9 <br /> <br />I <br /> <br />AN ORDINANCE OF TIlE CITY COUNCIL OF TIlE CITY <br />OF SAN MARCOS, TEXAS, A CITY DULY AND LEGALLY <br />INCORPORATED AND OPERATING AS A HCME RULE CITY <br />BY AND UNDER TIlE LAWS OF TIlE STATE OF TEXAS, <br />GRANTING TO TIlE LOWER COLORAOO RIVER AUlliORITY , <br />AN AGENCY OF TIlE STATE OF TEXAS> ITS SUCCESSORS <br />AND ASSIQI/S, UPON CERTAIN SPECIFIED CONDITIONS, <br />A ONE YEAR FRANOUSE, WIlli CERTAIN RIGlITS AND <br />PRIVILEGES INCIDENT TIlERETO, FOR TIlE DISTRIBUTION <br />OF ELECTRIC POWER AND ENERGY WIlliIN TIlE CORPORATE <br />LIMITS OF TIlE CITY OF SAN MARCOS, TEXAS, AS NOW <br />EXISTING OR HEREAFTER EXTENDED. <br /> <br />WHEREAS, the Lower Colorado River Authority has been distributing electric <br />power and energy for consl.Ullption within the City of San Marcos; and <br /> <br />WHEREAS, the Lower Colorado River Authority has previously received the <br />permission of the City, through a Franchise, to use its streets, alleys and <br />other public grounds in carrying out its business of distributing electric <br />power and energy to consumers in said City; and <br /> <br />WHEREAS, the City Council of the City of San Marcos possesses the authority, <br />by ordinance> to grant> renew, or amend all franchises for the distribution <br />of electric power and energy within the corporate limits of the City of <br />San Marcos, as now existing or hereafter extended; and <br /> <br />WHEREAS, the City Council of the City of San Marcos desires to extend the <br />Franchise of the Lower Colorado River Authority until January 1, 1977; <br />now,therefore <br /> <br />BE IT ORDAINED BY TIlE CITY COUNCIL OF TIlE CITY OF SAN MARCOS, TEXAS: <br /> <br />I <br /> <br />Part 1. That the Franchise agreement between the City of San Marcos, <br />Texas and the Lower Colorado River Authority, a copy of said agreement being <br />attached hereto and incorporated herein for all intents and purposes, be, and <br />is hereby, in all things approved. <br /> <br />Part 2.
