<br />I <br /> <br />I <br /> <br />I <br /> <br />38 <br /> <br />ORDINANCE NO. 1977-19,' <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, REPEALING THAT ORDINANCE <br />PROVIDING FOR 'AN AIR CONDITIONING CODE AS PASSED <br />AND ADOPTED ON SEPTEMBER 9, 1974; AND REPEALING <br />THAT ORDINANCE PROVIDING FOR AIR CONDITIONING <br />WORK FEES AS PASSED AND ADOPTED ON AUGUST 11, <br />1975; INCORPORATING PROVISIONS FROM SAID REPEALED <br />ORDINANCES INTO A SINGLE ORDINANCE HEREIN; ADOP- <br />TiENG THE "SOUTHERN STANDARD HEAlI.'ING AND AIR CON- <br />DITIONING CODE" AND AS HEREAFTER AMENDED; ADOPTING <br />THE "UNIFORM MECHANICAL CODE" AND AS HEREAFTER <br />AMENDED; PROVIDING. FOR A HEATING AND AIR CONDI- <br />TIONING INSPECTOR AND PRESCRIBING POWER AND DUTIES <br />OF THE POSITION; CREATING AN EXAMINING AND SUPER- <br />VISING BOARD OF HEATING AND AIR CONDITIONING <br />CONTRACTORS AND PRESCRIBING ITS POWERS AND DUTIES; <br />PROVIDING FOR THE LICENSING OF HEATING AND AIR <br />CONDITIONING CONTRACTORS AND INSTALLERS, THE <br />MANNER AND WAY IN WHICH CERTAIN HEATING AND AIR <br />CONDITIONING WORK SHALL BE DONE, THE KIND AND CL1'.SS <br />OF MATERIAL TO BE USED IN SUCH WORK; REQUIRING <br />PERMITS FOR CERTAIN KINDS OF HEATING AND AIR <br />CONDITIONING WORK; PROVIDING FOR HEATING AND AIR <br />CONDITIONING LICENSING FEES AND PERMIT FEES; <br />REPEALING ALL ORDINANCES, OR PARTS OF ORDINANCES <br />IN CONFLICT THEREWITH; PROVIDING A SEVERABILITY <br />CLAUSE; AND ESTABLISHING PENALTIES FOR VIOLATIONS; <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXA' <br /> <br />SECTION 1: DEFINITIONS. <br /> <br />A. That the term Master Heating and Air Conditioning Contrac <br />tor, as used in this Ordinance, is defined, to mean and include any] <br />person engaged in the business of installing or repairing or con- <br />tracting to' install or repair', heating and air conditioning or <br />refrigeration units, ahd eq~ipment used withtor on buildings for <br />the transmission of cooling 'or heating, together with the fittingsl <br />for same necessary for the protection of such air conditioning <br />uni ts and equipment. <br /> <br />B. That the term Journeyman, as used in this ordinance, is <br />defined to mean and include any person who does not contract with <br />the owner of a building (or other person procuring the services <br />of a Journeyman) but works for and under the direction of a <br />Master Heating and Air Conditioning Contractor. <br /> <br />C. That the term Maintenance Heating and Air Conditioning <br />License, Restricted, as used in this Ordinance, is defined to me~ <br />and include any person who is regularly employed by one employer <br />upon a permanent basis to do work of a heating and air conditioni, <br />nature, restricted to maintenance, repair, or replacement of any <br />heating or air conditioning equipment or similar work within the <br />con~ines of the building or premises of said employer. <br /> <br />SECTION 2: NATIONAL CODES ADOPTED. <br /> <br />That the'rules and regulations of'the Uniform Mechmlical Coo <br />1973 Edition, now and as hereafter amended, and the rules and reg <br />lations of the Southern Standard, Heating' and Air Conditioning Coe <br />1976 Edition, now and as hereafter amended, are hereby adopted by <br />the City of San Marcos, and shall be the rules and regulations <br />observed in all work, construction, installation, operation, and <br />maintenance of heating and air conditioning equipment, apparatus <br />and fixtures, except as otherwise specifically provided in this <br />Ordinance; and the same are hereby incorporated into this Ordin <br />for all intents and purposes. <br />
