172 <br />AN ORDINANCE OF THE CITY OF SAN MARCOS, TEXAS, <br />.y REPEALING CHAPTER 21 OF THE CODE OF ORDINANCES <br />OF THE CITY OF SAN MARCOS ENTITLED "POLICE" <br />ESTABLISHING THE POLICE DEPARTMENT ASSIGNING <br />THE POWERS AND DUTIES OF OFFICERS, ETC. AND <br />ENACTING A NEW CHAPTER 21, ENTITLED "PUBLIC <br />SAFETY", CREATING A PUBLIC SAFETY DIVISION <br />rY WITHIN THE CITY COMPRISED OF THE THREE DEPART- <br />MENTS OF UNIFORMED PATROL, CRIMINAL INVESTIGATION, <br />AND FIRE SUPPRESSION; PROVIDING FOR THE APPOINT- <br />MENT OF DEPARTMENTAL EMPLOYEES; ESTABLISHING <br />THE POWERS AND DUTIES OF DEPARTMENTAL PERSONNEL; <br />AND DECLARING AN EMERGENCY. <br />y <br />?;;l WHEREAS, the City Council desires to reorganize the Police and Fire Departments <br />of San Marcos, Texas pursuant to and within the confines of applicable state <br />and local law; now, therefore, <br />k BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br />SECTION 1. That Chapter 21 of the Code of Ordinances of the City of San Marcos, <br />Texas, entitled "Police" be, and is hereby, repealed and deleted from said Code <br />so as to be of no further force and effect. <br />SECTION 2. That there is hereby enacted a new Chapter of the Code of Ordinances <br />of the City of San Marcos to be codified as Chapter 21 of said Code and entitled <br />"Public Safety" said Chapter to be enacted and read as follows: <br />.* ARTICLE I. IN GENERAL <br />z <br />Section 21-1. PUBLIC SAFETY DIVISION CREATED. <br />° There is hereby created a Division of Public Safety within the City <br />of San Marcos, the head of which shall be the Director of Public Safety. <br />The Director shall be appointed by the City Manager and confirmed by <br />the City Council. The Director shall be the Chief Administrator and <br />Supervisor of the Uniformed Patrol, Criminal Investigation, and Fire <br />K Suppression department heads and the Director shall report directly to <br />the City Manager. <br />Section 21-2. DEPARTMENT OF UNIFORMED PATROL CREATED. <br />There is hereby created within the Public Safety Division a Department <br />of Uniformed Patrol, the head of which shall be the Commander of Uniformed <br />Patrol. The Commander shall be appointed by the City Manager and confirmed <br />4 by the City Council. The Commander shall be the administrator and super- <br />visor of all uniformed law enforcement officers employed by the City <br />assigned to patrol activities within the Department of Uniformed Patrol and <br />shall report directly to the Director of Public Safety. <br />Section 21-3. DEPARTMENT OF CRIMINAL INVESTIGATION CREATED. <br />There is hereby created within the Public Safety Division a Department <br />of Criminal Investigation, the head of which shall be the Commander of <br />Criminal Investigation. The Commander shall be appointed by the City Manager <br />and confirmed by the City Council. The Commander shall be the administrator <br />and supervisor of all law enforcement officers employed by the City <br />assigned to criminal investigation activities within the Department of <br />Criminal Investigation and shall report directly to the Director of Public <br />Safety. <br />Section 21-4. DEPARTMENT OF FIRE SUPPRESSION CREATED. <br />There is hereby created within the Public Safety Division a Department <br />of Fire Suppression, the head of which shall be the Commander of Fire <br />Suppression. The Commander shall be appointed by the City Manager and <br />confirmed by the City Council. The Commander shall be the administrator <br />and supervisor of all fire suppression personnel employed by the City <br />within the Department of Fire Suppression and shall report directly to <br />the Director of Public Safety.
