<br />AN ORDINANCE APPROVING THE PRICE AND CONDITIONS OF THE SALE
<br />BY THE URBAN RENEWAL AGENCY OF THE CITY OF SAN MARCOS, TEXAS,
<br />OF PARCEL NO. 5-1 (SEE LEGAL READING), LOCATED WITHIN THE
<br />JUAN VERAMENDI PROJECT, N. D . P ., TEX. A-6, TO URA LEE BEARD
<br />AND LEE J. BEARD, AND DECLARING AN EMERGENCY.
<br />
<br />WHEREAS, the Urban Renewal Agency of the City of San Marcos, Texas, advertis,~d for
<br />bids for the sale of certain property available for disposition within its ~lan
<br />Veramendi Project N.D.P., Tex. A-6, in the San Marcos Record, a local newsp~~er
<br />with a general circulation within the City of San Marcos, Hays County, Texas; and

<br />WHEREAS, pursuant to said advertisement there was a bid submitted by Ura Lee Beard
<br />and Lee J. Beard for all of Parcel No. 5-1 within said project; and
<br />
<br />WHEREAS, the said bid met the minimUm disposition price set upon said property by
<br />the Agency; and
<br />
<br />WHEREAS, said bid was accepted by the Board of Commissioners of the Urban Renewal
<br />Agency of the City of San Marcos, Texas, after the bid opening of March 1,'1976, and
<br />by a Resolution duly passed on April 6, 1976, and whereas said Resolution authorizes
<br />sale to Ura Lee Beard and Lee J. Beard, and recommended the acceptance and approval
<br />of the terms and conditions of the sale to the City Council; and
<br />
<br />WHEREAS, the aforementioned bid and proposed use set forth in said bid and its terms e
<br />conditions conform to the Redevelopment Plan for the Juan Veramendi Project, N.D.P.,
<br />Tex. A-6, and conform to the plan for the development of the City as a whole; now,
<br />therefore,

<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY 'OF SAN 'MARCOS, TEXAS:
<br />
<br />PART 1. That the price and conditions of the sale by the Urban Renewal Agency of
<br />the City of San Marcos, Texas, of 'all of Parcel No. 5-1 within the Juan Veramendi
<br />Project, N.D.P., Tex. A-6, to Ura Lee Beard and Lee J. Beard, are hereby ap~roved
<br />in accordance with Section 11, of Article l269L~3, Vernon's Annotated Civil Statutes
<br />of Texas.

<br />PART 2. That the property to be sold as authorized' in paragraph l' above is more
<br />particularly described by field notes attached hereto and marked as Exhibit "An of
<br />this Ordinance.
<br />
<br />PART 3. That the consideration for said sale being $125,000.00 for 48,676 square feet
<br />is also hereby approved.
<br />
<br />PART 4. That the sale by the Urban Renewal Agency is made subject to the restriction
<br />of the Redevelopment Plan for the Juan Veramendi Project, N.D.P., Tex. A-6, as
<br />approved and amended and on file in the office of the Director of Community Developmer
<br />
<br />PART 5. That the purchaser is hereby placed on notice that the subject property is
<br />subject to assessment under the provisions of Article 1105b of the Revised Civil
<br />Statutes of Texas, now and as hereafter amended.
<br />
<br />PART 6. That the ocndition of the disposition documents, including the Deed and
<br />Contract for Sale of Land for Private Redevelopment, a copy of which is on file in
<br />the office of the Director of Community Development.

<br />PART 7. That the importance of this Ordinance creates an emergency and an i,mperati ve
<br />purpose necessary that the provisions of the Charter requiring that all ordi.nances be
<br />read at three separate meetings and that no ordinance shall become effective until th.
<br />expiration of 10 days following the date of its final passage be suspended, and this
<br />provision<is hereby suspended, and this Ordinance shall take effect and be in force fJ
<br />and after its adoption, and publication in a newspaper of general circulation within
<br />the City.
