<br />I <br /> <br />24 <br /> <br />ORDINANCE NO. 1976 - 16 <br /> <br />I <br /> <br />AN ORDINANCE OF THE CITY OF SAN MARCOS, TEXAS, AMENDING <br />THE CODE OF ORDINANCES OF THE CITY OF SAN MARCOS, TEXAS, <br />BY ADDING A NEW CHAPTER NUMBERED 32, ENTITLED "FAIR HOUSING" <br />SO AS TO DECLARE AND ESTABLISH THE POLICY OF THE CITY TO <br />FURTHER THE RIGHT OF EACH INDIVIDUAL TO PROVIDE A DWELLING <br />FOR SUCH PERSON AND/OR SUCH PERSON'S FAMILY, INCLUDING THE <br />FINANCING THEREOF WITHOUT REGARD TO SEX, RACE, COLOR, <br />RELIGION, OR NATIONAL ORIGIN; ADOPTING REGULATIONS' FOR <br />BROKERAGE SERVICES PROHIBITING DISCRIMINATION BASED ON SEX, <br />RACE, COLOR, RELIGION, OR NATIONAL ORIGIN; PROHIBITING <br />INTIMIDATION; PROVIDING FOR CERTAIN EXEMPTIONS AND EXCLUSIONS; <br />ESTABLISHING A PROCEDURE FOR THE HANDLING OF COMPLAINTS; <br />OUTLINING THE DUTIES OF THE FAIR 'HOUSING OFFICER; PROVIDING <br />FOR THE CREATION OF A FAIR HOUSING COMMISSION WITHIN THE CITY <br />OF SAN MARCOS; PROVIDING PENALTIES FOR THE VIOLATION OF ANY <br />OF THE PROVISIONS OF THIS ORDINANCE; CLARIFYING CONFLICTING <br />ORDINANCES; PROVIDING A SAVINGS CLAUSE; PROVIDING AN EFFECTIVE <br />DATE; AND PROVIDING FOR THE PUBLICATION OF THIS ORDINANCE. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />SECTION 1: There is hereby created and enacted a Fair Housing Ordinance for the <br />Ci ty of San Marcos, Texas, to be codified as Chapter 32 of the Code of Ordinances <br />of the City of San Marcos, Texas, entitled "Fair Housing", said Ordinance to be <br />enacted so as to read as follows: <br /> <br />ARTICLE I: GENERAL PROVISIONS <br /> <br />Section 32-1. ~. <br /> <br />This Ordinance shall, from and after the date of its adoption, be kno'lll, <br />cited, and called the Fair Housing Ordinance of the City of San Marcos, Texas. <br /> <br />SECTION 32-2. Authority. <br /> <br />This Ordinance is adopted pursuant to the authority of Article 1, Section 3A <br />and Article 11, Section 5 of the Constitution of the State of Texas, Articles 1165 <br />and 1175, Revised Civil Statutes of Texas (1925), and 42 U.S.C.A. 3608 et.8e'l., and <br />Section 12.10 of the Charter of the City of San Marcos, Texas. <br /> <br />SECTION 32-3. Purpose. <br /> <br />The citizens of San Marcos must be provided with appropriate guidelines and <br />mechanisms to ensure, maintain and protect the right of each individual to provide <br />for housing for that person or that person's family according to their own choosing. <br />This Fair Housing Ordinance, in conjunction with any other fair housing control <br />tools as now and hereafter may be adopted by the City, provides these guidelines <br />and mechanisms. With this in mind, it is the nature, intent, and stated purpose <br />of this Fair Housing Ordinance to: <br /> <br />(A) Afford each individual person through fair, orderly, and lawful procedure" <br />an opportunity to obtain housing without regard to said person's sex, race, color, <br />religion, or national origina <br /> <br />(B) Regulate the practices and policies of brokerage services to ensure that <br />each person is fairly, justly, and lawfully treated, represented and considered for <br />the sale, purchase, and rental of the dwelling without regard to said person's sex, <br />race, color, religion, or national origin. <br /> <br />I <br /> <br />(C) Regulate the practices and policies of financial institutions to ensure <br />that each person is fairly, justly, and lawfully treated, represented and <br />considered in the financing of a dwelling without regard to said person's sex, <br />race, color, religion, or national origin. <br /> <br />(D) Enhance, preserve, and improve the 'luality of life within the community. <br /> <br />(E) Recognize the right of each person to provide for such person and that <br />person's family a dwelling of their choosing and that denial of such right through <br />
