<br />I <br /> <br />I <br /> <br />I <br /> <br />50 <br /> <br />ORDINANCE NO. 1976 - 22 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, PROVIDING FOR THE CLOSING AND <br />ABANDONMENT OF RIGHT-OF-WAY PRESENTLY BEING USED <br />BY THE PUBLIC ON THAT PROPERTY COMMONLY KNOWN AS <br />"THE OLD MILL PROPERTY" SITUATED IN THE CITY OF <br />SAN MARCOS, TEXAS; QUITCLAIMING SAID ABANDONED <br />AREA TO THE ABUTTING PROPERTY OWNER; PROVIDING <br />FOR THE TERMS AND CONDITIONS OF: SUCH ABANDONMENT; <br />AND AUTHORIZING THE MAYOR OF THE CITY OF SAN MARCOS <br />TO EXECNTE SAID QUITCLAIM DEED ON. BEHALF OF THE <br />CITY. <br /> <br />WHEREAS, the City Council of. the City of San Marcos, <br />Texas, has previously approved an agreement between H. Garland <br />Stokes, Mildred O. Stokes, and Herbert Yarbrough, Jr., and the <br />City of San Marcos for the exchange of right-of-way across that <br />property commonly known as "The Old Mill Property;" and, <br /> <br />WHEREAS, it is the opinion of the City Council that sllch <br />abandonment is in the public interest of the City of San Marcos, <br />Texas; now, therefo.re, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS: <br /> <br />SECTION 1: That that right-of-way described in Section <br />2 of this ordinance now being used. across the property hereinafter <br />described traversing that property commonly known as "The Old Mill <br />Propert~' situat6d in the City of San Marcos, Hays County, Texas, <br />be, and the same is.hereby, abandoned, vacated, and closed insofar <br />as the right, title, and easement of the public are concerned; <br />said property being more particularly described as follows: <br /> <br />TRACT NO. 1. Being all of Lots 10, 11, 12, 13, 1 and <br />2 of Block 2 of Donaldson's.Addition to. the City of <br />San Marcos, Texas, save and except a strip 12 1/2 feet <br />wide taken off the entire east side Lots Nos. 1 and 2, <br />heretofore conveyed foi.highway purposes. <br />, <br /> <br />TRACT NO.2. A triangular tract of land bounded on <br />the north by Lots Nos. 12, 11 and 1, Block No.2 of <br />Donaldson's Addition to the City of San Marcos, Texas, <br />on the west by the east line of the I.G.N. Railroad <br />Company right-of-way, on the southeast by the northwest <br />line of the M.K.T. Railroad Company right-of-way, and. <br />being all of that three acre tract of land conveyed by <br />W.R. McKie et ux to.S. Woodall by deed recorded in <br />Volume 30, Page 458, Deed Records, Hays County, Texas. <br />Lying north of the M.K.T. Railroad Company's right-of- <br />way and that (53/100) acre tract of land conveyed by <br />W.S. Hightower et ux to W.D. Wood by deed recorded in <br />Volume 32, Page 327, Deed Records of Hays County, <br />Texas, and that tract of land conveyed by W.R. McKie <br />to.San Marcos Oil and Gin Company by deed recorded <br />in Volume 32, Page 347, Deed Records of Hays County, <br />Texas. <br /> <br />SECTION 2: That the City of. San_Marcos, Texas, does, by <br />these presents quitclaim all its right, title, claim, and demand i <br />in and to those tracts of land, described herein below, to H. <br />Garland Stokes, Mildred O. Stokes, and Herbert Yarbrough, Jr., <br />in exchange for the dedication of right-of-way described in <br />Section 3 of this ordinance. The property hereby released and <br />quitclaimed is described as follows: <br /> <br />All that portion of the above described Stokes- <br />Yarbrough tract of land being an existing meandering <br />20.0 foot, more or less, gravel road which is generally <br />east to west across said Stokes Property, and which <br />
