James McIvor; Francis Anderson; <br />Joe Martin; Catarino Villalpando; Art Ables; Mr. & Mrs. Calvin <br />Cowan: Forrest Cockrell; Charles Caffey; Jerri Martin; Melissa <br />Millecam; Terry Roberts; and others. <br />The Mayor called the meeting to order at 7:30 p.m. <br />The Minutes of the Regular Meeting held December 16, 1974, were approved on <br />motion of Mr. Hansen and second of Mr. Cunningham, with Mr. Flores abstaining. <br />Jim Broussard, Chairman of the Charter Review Commission, came before the Council <br />with recommendations of the Commission. They are attached and made a part of <br />these Minutes. <br />The Mayor introduced a request for the re-platting of Lot 2 of Block 11 of the <br />Original Town of San Marcos, located at 1nO and 109 North Guadalupe. J.B. Roberts <br />represented the applicant, Mrs. Laura Ramsay Roberts. Mr. Breihan stated his <br />concern that, if the lot were re-platted and a portion used for C-2 zoning, garbage <br />would be a problem since the building has no exit onto an alley and containers <br />would be left on the street. Mr. Roberts told the Council consideration was being <br />given the possibility of renting space in an adjacent building for kitchen facilities. <br />The City Attorney advised that this action would probably require approval from <br />the Planning and Zoning Commission and Council. Mr. Sutton moved the request be <br />tabled pending further study of the situation. Mr. Flores seconded the motion, <br />which passed unanimously. <br />Mr. Breihan moved to table the scheduled public hearing to consider rezoning of <br />a portion of the above-described property. Mr. Hansen seconded the motion, <br />which passed unanimously. <br />The Mayor opened a Public Hearing to consider a request for a change in zoning <br />of Lot 54 of the J.M. Stone Addition from "D" to "C". The Reverend James McIvor <br />was present to request the change so the property could be used for a used-clothing <br />store. He asked if, in view of the fact that the store would be a project of <br />St. John's Church, a better change would be to "P-2". The City Attorney replied <br />that such a usage would not fall within the legal definition of "P-2" zoning. <br />Francis Anderson and Joe Martin, owners of property within 200 feet of that in <br />question, came before the Council to object to the change on the basis that an <br />increase in traffic would be hazardous in the neighborhood. It was noted that the <br />Planning and Zoning Commission had recommended denial of the request, and that a <br />duly sworn petition containing the signatures of more than twenty percent of property <br />owners within 200 feet of the property in question had been presented in objection. <br />The Mayor closed the hearing and read the caption of an ordinance as follows:
