<br />150 <br /> <br />ORDINANCE NO. 1975 - 4 <br /> <br />AN ORDINANCE OF THE CITY OF SAN MARCOS, TEXAS, AMENDING <br />SECTION 16 OF APPENDIX A OF THE CODE OF ORDINANCES OF THE <br />CITY OF SAN MARCOS BY DELETING SECTION 16(3) AND SUBSTI- <br />TUTING IN ITS PLACE A NEW SUBSECTION {3) TO SECTION 19 SO <br />AS TO ESTABLISH MINIMUM OFF-STREET PARKING REGULATIONS AND <br />STANDARDS FOR ALL MULTI-FAMILY DISTRICTS AND STRUCTURES; <br />AND DECLARING AN EMERGENCY. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />I <br /> <br />SECTION 1. That Section 16, subsection 3 of Appendix A of the Code of Ordinances <br />of the City of San Marcos, Texas, be, and is hereby, deleted and in all things <br />t;epealed. <br /> <br />SECTION 2. That a new subsection 3 of Section 16 of Appendix A of said Code be, <br />and is hereby, approved, enacted, and adopted so as to read as follows: <br /> <br />3. For any multi-family dwelling in any zoning district or for any <br />structure altered into a multi-family dwelling from any other classifi- <br />cation, off-street parking spaces shall be provided in accordance <br />with the following schedule. For each: <br /> <br />Efficiency Apartment <br />One (1) Bedroom Apartment <br />Two (2) Bedroom Apartment <br />Each Additional Bedroom <br /> <br />1 1/2 Spaces <br />2 Spaces <br />3 Spaces <br />1 Space <br /> <br />When the computation for the number of parking spaces required under <br />this Ordinance results in the requirement of a fractional space, the <br />fractional space requirement shall be satisfied by adding one additional <br />space to the whole-space total. <br /> <br />I <br /> <br />All parking areas and spaces shall be designed and constructed in accordance <br />with the attached tables and illustrative diagrams as approved by the City <br />Council as evidenced by Exhibit "A" and "B" attached hereto and incorporated <br />herein. Said tables and diagrams shall be kept of record in the office of <br />the City Secretary and Director of Public Works for inspection by the public <br />during reasonable office hours. In addition: <br /> <br />A. All parking areas and spaces shall be designed and constructed so as <br />to have free ingress and egress at all times. <br /> <br />B. No parking space or parking area shall be designed so as to require <br />a vehicle to back into a public street or alleyway. <br /> <br />C. No parking space or parking area shall be constructed with a slope of <br />more than six percent (6%). In such cases where a variance may be granted <br />to construct a parking area with a slope of more than six percent (6%), <br />which in no instance shall exceed twelve percent (12%), each parking space <br />shall be constructed at right angles to the slope. In the event the Board <br />of Adjustment shall consider a variance, the Board of Adjustment shall have <br />the authority to impose drainage standards calculated to minimize the effect <br />of the increased slope. <br /> <br />I <br /> <br />D. All parking areas and parking spaces shall be designed and constructed <br />to protect adjacent residences from the direct glare of headlights of <br />vehicles using the parking area. In accordance, all .off-street parking <br />areas shall be effectively screened on each side by a solid wall or fence <br />from any adjoining property. Such wall or fence shall not be less than <br />four (4) feet or more than six (6) feet in height, shall be placed on the <br />property line, and shall be maintained in good condition, without any adver- <br />tising thereon. The space between such wall or fence and the lot line of any <br />adjoining residential property shall be landscaped with grass, hardy shrubs, <br />or evergreen ground cover. In lieu of such wall or fence, a strip of land <br />not less than ten (10) feet in width and planted and maintained with an <br />evergreen hedge, or dense planting of evergreen shrubs, not less than <br />four (4) feet in height, may be substituted. <br /> <br />E. All parking areas and parking spaces shall have an all-weather surface <br />consisting of asphaltic concrete or portland cement concrete. Said area <br />and spaces shall be constructed in accordance with Exhibit "c" attached <br />hereto and incorporated herein for all intents and purposes, a copy of which <br />is kept of record in the office of the City Secretary and Director of Public <br />Works for inspection by the public during reasonable office hours. <br />
