<br />10 <br /> <br />ORDINANCE NO. 1975 - 16 <br /> <br />AN ORDINANCE AMENDING THAT CERTAIN ORDINANCE KNOWN AS <br />THE SUBDIVISION ORDINANCE OF THE CITY OF SAN MARCOS, <br />TEXAS, CODIFIED AS APPENDIX C IN THE CODE OF ORDINANCES <br />OF THE CITY OF SAN MARCOS, TEXAS, BY DELETING SUBSECTION <br />2-B 'OF SECTION I, ENTITLED "LOTS", OF ARTICLE 7, ENTITLED <br />"SUBDIVISION DESIGN REQUIREMENTS", AND ADDING A NE~) <br />SUBSECTION 2-B THERETO PROVIDING FOR MINIMUM LOT REQUIRE- <br />MENT FOR TOWNHOUSES, REQUIRING OPEN SPACE, AND ESTABLISHING <br />OTHER LOT CRITERIA. <br /> <br />I <br /> <br />NOW, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />SECTION 1. That subsection 2-B of Section I of Article 7 of the Subdivision <br />Ordinance af San Marcos, Texas, codified as Appendix C of the Code of Ordinances <br />be, and is hereby, deleted and removed from said Ordinance. <br /> <br />SECTION 2. That in replacement of said subsection, a new subsection 2-B be added <br />to Section I, Article 7 of the Subdivision Ordinance of the City of San Marcos, <br />codified as Appendix C to said Code of Ordinances so as to read as follows: <br /> <br />Townhouse. Townhouse lots may be created where each townhouse lot is to <br />be served by a public sewerage system subject to the following conditions, <br />in addition to those applicable to all other subdivisions in this Ordinance. <br /> <br />1. Only one (1) townhouse may be constructed per lot with a minimum of <br />three (3) and a maximum of twelve (12) adjoining units in anyone <br />development. <br /> <br />2. Lot area shall be a mlnlmum of two thousand, five hundred square <br />feet (2500 sq. ft.). <br /> <br />3. Lot width shall be a minimum of twenty-five feet (25'). <br /> <br />I <br /> <br />4. Where townhouse lots and dwelling units are designed to face upon an <br />open or common court, rather than upon a public street, said open or <br />common court shall be aLleast forty feet.(40') wide and not more than <br />two hundred feet (200') long, measured from the public street upon which <br />the court must open. Said court may nat include vehicular drives or <br />parking area in front of dwelling units. <br /> <br />5. A minimum of two (2) parking spaces per dwelling unit shall be provided <br />in off-street parking and shall not be constructed within minimum set-back <br />areaSe <br /> <br />6. Lot size may be reduced under the prOV1Slon that open space, as defined <br />herein, be dedicated according to the following schedule: <br /> <br />For every ane chundred square feet (100 sq. ft.) of open space per <br />lot provided, the minimum lot area may be reduced by two hundred <br />square feet (200 sq. ft.).
