<br />91 <br /> <br />ORDINANCE NO. 1974 - 13 <br /> <br />I <br /> <br />AN ORDINANCE AMENDING THE APPENDIX TO THE <br />CODE OF ORDINANCES OF THE CITY OF SAN MARCOS <br />BY CREATING APPENDIX E, PROVIDING MINIMUM <br />STANDARDS FOR MOBILE HOME PARKS; ESTABLISHING <br />REQUIREMENTS FOR DESIGN, CONSTRUCTION, ALTER- <br />ATION, EXTENSION AND MAINTENANCE OF MOBILE <br />HOME PARKS AND RELATED UTILITIES AND FACILITIES; <br />AUTHORIZING THE ISSUANCE OF PERMITS FOR <br />CONSTRUCTION, ALTERATION AND EXTENSION OF <br />MOBILE HOME PARKS; AUTHORIZING THE INSPECTION <br />OF MOBILE HOME PARKS; FIXING PENALTIES FOR <br />VIOLATIONS; AND PROVIDING AN EFFECTIVE DATE. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, THAT: <br /> <br />This Ordinance shall be called "The Mobile Home Parks Ordinance". <br /> <br />Section 1. Definitions. <br /> <br />For the purpose of this Ordinance, certain terms, words and <br />phrases shall have the meaning hereinafter ascribed thereto. <br /> <br />A. Agent. Any person authorized by the owner of a mobile <br />home park to operate or maintain such park under the provisions <br />of this Ordinance. <br /> <br />B. Building Official. The legally designated inspection <br />authority of the City, or his authorized representative. <br /> <br />I <br /> <br />C. Certificate of Occupancy. A certificate issued by the <br />Building Official for the use of a building, structure, and/or <br />land, when the building, structure, and/or land complies with <br />the provisions of all applicable City codes and regulations. <br /> <br />D. Director of Public Works. The duly authorized employee <br />or representative of the City in charge of the street, water and <br />sewer department or any combination thereof. <br /> <br />E. City Health Officer. The legally designated head of the <br />City Health Department, or his authorized representative. <br /> <br />F. City Official. The legally designated head of a City <br />department, or his authorized representative when acting in an <br />official capacity. <br /> <br />G.' Common Access Route. A private way which affords the <br />principal means of access to individual mobile home lots or <br />auxiliary buildings. <br /> <br />H. Driveway. A minor entranceway off the common access <br />route within the park, into an off-street parking area serving <br />one or more mobile homes. <br /> <br />I <br /> <br />I. Fire Chief. The legally designated chief of the Fire <br />Department of the City, or his authorized representative. <br /> <br />J. Internal Street. Same as common access route. <br /> <br />K. Mobile Home. A movable or portable dwelling constructed <br />to be towed by a motor vehicle on its own chassis over Texas <br />roads and highways, connected to utilities, and designed without <br />a permanent foundation for year-round living. It may consist of <br />one or more units that can be telescoped when towed and extended <br />later for additional capacity, or two or more units separately <br />towable but designed to be joined into one integral unit. <br />
