<br />99 <br /> <br />ORDINANCE NO. 1974 - 14 <br /> <br />I <br /> <br />AN ORDINANCE AMENDING APPENDIX A, GENERAL ZONING ORDINANCE <br />OF THE CODE OF ORDINANCES OF THE CITY OF SAN MARCOS, TEXAS, <br />BY THE ADDITION TO SECTION 4, ENTITLED "DEFINITIONS" FOR A <br />"MOBILE HOME PARK" AND A "MOBILE HOME"; ALSO AMENDING SECTION <br />5.A. OF SAID APPENDIX ENTITLED "DISTRICTS DESIGNATED" BY <br />ADDING THE DESIGNATION "MHP" FOR MOBILE HOME PARKS: BY <br />DELETING SECTION 15.1 OF SAID APPENDIX ENTITLED "TEMPORARY <br />USE OF LAND BY TRAILER HOUSES" AND SUBSTITUTING AN ENTIRELY <br />NEW SECTION UNDER THE SAME NUMBER ENTITLED "MOBILE HOME"; <br />ESTABLISHING A SECTION 15.2 OF SAID APPENDIX ENTITLED <br />"TEMPORARY USE OF LAND BY MOBILE HOMES"; AND PROVIDING AN <br />EFFECTIVE DATE. <br /> <br />WHEREAS, the City Council of the City of San Marcos, Texas, has heretofore <br />enacted a comprehensive mobile home ordinance: and, <br /> <br />WHEREAS, the Ciuy Council is of the opinion that the City's zoning ordinance <br />should be amended so as to be consistent with said mobile home ordinance: and, <br /> <br />WHEREAS, the City Council desires to establish a zoning district designation <br />for mobile home parks; now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />Part 1. That Section 4, "Definitions", of Appendix A, General Zoning <br />Ordinance of the Code of Ordinances of the City of San Marcos, be and <br />is hereby amended to include definitions for a mobile home and a mobile <br />home park as follows: <br /> <br />Mobile Home. A movable or portable dwelling constructed to be towed by <br />a motor vehicle on its own chassis over Texas roads and highways, connected to <br />utilities, and designed without a permanent foundation for year-round living. <br />It may consist of one or more units that can be telescoped when towed and <br />extended later for additional capacity, or two or more units separately <br />towable but designed to be joined into one integral unit. <br /> <br />I <br /> <br />Mobile Home Park. A development of three or more mobile home spaces <br />arranged on a tract of land in which the tenants of the mobile homes are not <br />the owners of the land. If the tenant of the mobile home is the owner of the <br />mobile hime itself and the owner of the land on which this respective mobile <br />home is located then it will be exempt from being classified as a mobile home <br />park. <br /> <br />Part 2. That Section 5., "Districts Designated" of said Appendix A of the <br />Code of Ordinances of the Ctfy of San Marcos be and is hereby amended to include <br />a "MHP" zoning district designation for mobile home parks as follows: <br /> <br />IIMBP" <br /> <br />Mobile Home Park <br />(See Section 15.1 and 15.2) <br /> <br />Part 3. That Section 15.1, "Temporary Use of Land by Trailer Houses", of said <br />Appendix A of the Code of Ordinances of the City of San Marcos, be, and is <br />hereby deleted: and an entirely new section, under the same aumber but with a <br />new title, be, and is hereby substituted therefore, so that Section 15.1 shall <br />henceforth read as follows. <br /> <br />Section 15.1. Mobile Homes. <br /> <br />I <br /> <br />A mobile home, as that term is defined in Section 4 of this Ordinance, <br />may be placed 1.) only within the bounds of an authorized, certified, and <br />licenses mobile home park, as that term is defined in Section 4 of this Ordinance, <br />or 2.) on land authorized for temporary mobile home use as provided in Section <br />15.2 herein. <br /> <br />Part 4. That Section 15.2, "Temporary Use of Land by Mobile Homes", of said <br />Appendix A of the Code of Ordinances of the City of San Marcos, be, and is hereby <br />established and added to said Code, and shall read as follows. <br />
