99 ORDINANCE NO. 1974 - 14 I AN ORDINANCE AMENDING APPENDIX A, GENERAL ZONING ORDINANCE OF THE CODE OF ORDINANCES OF THE CITY OF SAN MARCOS, TEXAS, BY THE ADDITION TO SECTION 4, ENTITLED "DEFINITIONS" FOR A "MOBILE HOME PARK" AND A "MOBILE HOME"; ALSO AMENDING SECTION 5.A. OF SAID APPENDIX ENTITLED "DISTRICTS DESIGNATED" BY ADDING THE DESIGNATION "MHP" FOR MOBILE HOME PARKS: BY DELETING SECTION 15.1 OF SAID APPENDIX ENTITLED "TEMPORARY USE OF LAND BY TRAILER HOUSES" AND SUBSTITUTING AN ENTIRELY NEW SECTION UNDER THE SAME NUMBER ENTITLED "MOBILE HOME"; ESTABLISHING A SECTION 15.2 OF SAID APPENDIX ENTITLED "TEMPORARY USE OF LAND BY MOBILE HOMES"; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of San Marcos, Texas, has heretofore enacted a comprehensive mobile home ordinance: and, WHEREAS, the Ciuy Council is of the opinion that the City's zoning ordinance should be amended so as to be consistent with said mobile home ordinance: and, WHEREAS, the City Council desires to establish a zoning district designation for mobile home parks; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: Part 1. That Section 4, "Definitions", of Appendix A, General Zoning Ordinance of the Code of Ordinances of the City of San Marcos, be and is hereby amended to include definitions for a mobile home and a mobile home park as follows: Mobile Home. A movable or portable dwelling constructed to be towed by a motor vehicle on its own chassis over Texas roads and highways, connected to utilities, and designed without a permanent foundation for year-round living. It may consist of one or more units that can be telescoped when towed and extended later for additional capacity, or two or more units separately towable but designed to be joined into one integral unit. I Mobile Home Park. A development of three or more mobile home spaces arranged on a tract of land in which the tenants of the mobile homes are not the owners of the land. If the tenant of the mobile home is the owner of the mobile hime itself and the owner of the land on which this respective mobile home is located then it will be exempt from being classified as a mobile home park. Part 2. That Section 5., "Districts Designated" of said Appendix A of the Code of Ordinances of the Ctfy of San Marcos be and is hereby amended to include a "MHP" zoning district designation for mobile home parks as follows: IIMBP" Mobile Home Park (See Section 15.1 and 15.2) Part 3. That Section 15.1, "Temporary Use of Land by Trailer Houses", of said Appendix A of the Code of Ordinances of the City of San Marcos, be, and is hereby deleted: and an entirely new section, under the same aumber but with a new title, be, and is hereby substituted therefore, so that Section 15.1 shall henceforth read as follows. Section 15.1. Mobile Homes. I A mobile home, as that term is defined in Section 4 of this Ordinance, may be placed 1.) only within the bounds of an authorized, certified, and licenses mobile home park, as that term is defined in Section 4 of this Ordinance, or 2.) on land authorized for temporary mobile home use as provided in Section 15.2 herein. Part 4. That Section 15.2, "Temporary Use of Land by Mobile Homes", of said Appendix A of the Code of Ordinances of the City of San Marcos, be, and is hereby established and added to said Code, and shall read as follows.
