ORDINANCE 1981-:25 158 AN ORDINANCE ©F THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE PRICE AND CONDITIONS OF THE SALE BY THE CITY OF SAN MARCOS, TEXAS OF A PORTION OF THAT TRACT OF LAND CONVEYED TO FELIPE DELEON BY J.F. PARSONS AND LAWRENCE R. PARSONS, JR. BY DEED DATED DECEMBER 6, 1945 AND RECORDED IN VOLUME 133, PAGES 315-316, HAYS COUNTY DEED RECORDS, TO ASCENCION ESQUIVEL; AUTHORIZING THE MAYOR PRO- TEMPORE TO EXECUTE A SPECIAL WARRANTY DEED TO ASCEN~CION ESQUIVEL; AND DECLARING AN EMERGENCY. WHEREAS, the City of San Marcos, Texas acquired all that right, title and interest conveyed by Sheriff's Deed dated June 13, 1961, in and to a portion of that tract of land con- veyed to Felipe DeLeon by J.F. Parsons and Lawrence R. Parsons, Jr. by deed dated December 6, 1945 and recorded in Volume 133, Pages 315-316, Hays County Deed Records, said portion described more particularly by metes and bounds as follows: Beginning at the south corner of the compress property in San Marcos, Hays County, Texas, as the same is located in a deed dated July 1, 1943 from E.M. Cape and Clara Louise Cape to J.R. Wallace, which said deed is now of~ t~he record in the deed records of Hays County, Texas, in Vol. 127, at pages 399-400, and the said deed with the said record of the same are here referred to and made part hereof for all pertinent purposes for loca- tion of the said south corner of said compress property; Thence N. 46° -4' W. 48 feet to a point for corner which said corner is the east and beginning corner of the tract of land hereby conveyed; Thence S. 43~ 045' W. 108.7 feet to a point-for corner which said corner is the south corner of the tract of land hereby conveyed; Thence N. 45~ -20'W. 25 feet to a point for corner which said corner is the west corner of that tract of land hereby conveyed; Thence N. 43° -45' E. 108.3 feet to .a point for corner, which said corner is the north corner of the tract of land hereby conveyed, said mentioned corner being also in the northwest boundary line of the above mentioned compress property, Thence S. 460 -4' E. 25 feet along the said north- west boundary line of the said compress property to the point of beginning being ~he above mentioned east corner of the said tract of land hereby conveyed as trustee for itself, the State of Texas, the County of Hays, and the San Marcos Consolidated Independent School District; and, WHEREAS, said portion was not redeemed by the former owners within the statutory period; and, WHEREAS, the City of San Marcos as trustee for itself, the S~ate of Texas, the County of Hays and the San Marcos Consolidated Independent School District, duly. advertised said portion for sale in a newspaper of general circulation in the City on January 11, 1981 and January 18, 1981; and,
