139. ORDINANCE NO. 2002- 16 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING CHAPTER 114, ZONING, OF THE CITY CODE BY ADDING NEW DIVISIONS TO ARTICLE 5 FOR "DPR-l" AND "DPR-2" TWO-FAMILY RESTRICTED DWELLING DISTRICTS; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENAL TIES. RECITALS: 1. The City Planning and Zoning Commission conducted a public hearing on October 23, 2001 on a proposed amendment to the Zoning Chapter of the City Code to add a new division to Article 5 for "DPR-1" Two-Family Restricted Dwelling Districts (Low Density). 2. The City Planning and Zoning Commission conducted a public hearing on November 13, 2001 on a proposed amendment to the Zoning Chapter of the City Code to add a new division to Article 5 for "DPR-2" Two-Family Restricted Dwelling Districts (Medium Density). 3. The Planning and Zoning Commission voted on October 23, 2001 and November 13, 2001, to recommend the proposed amendments for adoption by the City Council. 4. The City Council conducted a public hearing on the proposed changes on 28th January ,2002. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The Zoning Chapter (Chapter 114) ofthe City Code is amended by adding the following new Division 9 and Division 10 to Article 5, Districts, and by appropriately renumbering the current Divisions 9 and 10 and all subsequent divisions in that article: DIVISION 9. DPR-1 TWO-FAMILY RESTRICTED DWELLING DISTRICT (LOW DENSITY) Sec. 114.229. Permitted uses. The uses permitted in the DPR-1 two-family restricted dwelling district are as follows: (l) Single-family detached dwelling, subject to the restrictions of section 114.181 (l). (2) Two-unit townhouse, subject to the restrictions of Section 114.241 (1). (3) Duplex, duplex condominiums, limited to occupancy by a family having no more C:\TEMP\zoning text amd-duplex.doc 1
