<br /> <br />49 <br /> <br />ORDINANCE 1982-23 <br /> <br /> <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, AMENDING CHAPTER <br />21, ENTITLED "PUBLIC SAFETY," OF THE CODE <br />OF ORDINANCES OF SAID CITY TO ELIMINATE THE <br />POSITION OF DIRECTOR OF PUBLIC SAFETY; TO <br />ABOLISH THE CONCEPT OF A DIVISION OF PUBLIC <br />SAFETY; TO SPECIFY TERMINOLOGY FOR DEPART- <br />MENT HEADS; AMENDING SECTIONS 10-17 AND <br />10-18 OF SAID CODE TO SPECIFY SUPERVISOR OF <br />FIRE MARSHAL; REPEALING CONFLICTING OR- <br />DINANCES; PROVIDING FOR SEPARABILITY AND <br />DECLARING AN EMERGENCY. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That Chapter 21 of the Code of Ordinances, City <br />of San Marcos, Texas, is hereby amended to read as follows: <br /> <br />Chapter 21 <br />PUBLIC SAFETY <br /> <br />ARTICLE I. IN GENERAL <br /> <br />Sec. 21-1. Police department created. <br /> <br />There is hereby created an administrative unit to be <br />known as the police department, the head of which shall <br />be the chief of police. The chief of police shall be <br />appointed by the city manager and confirmed by the city <br />council. The police chief shall be the administrator <br />and supervisor of all law enforcement officers employed <br />by the city assigned within the police department as <br />well as the supervisor of all civilian employees of <br />the police department and shall report directly to the <br />city manager. <br /> <br />Sec. 21-2. Fire department created. <br /> <br />There is hereby created an administrative unit to be <br />known as the fire department, the head of which shall <br />be the fire chief. The fire chief shall be appointed <br />by the city manager and confirmed by the city council. <br />The fire chief shall be the administrator and supervisor <br />of all personnel employed by the city within the fire <br />department as well as all civilian employees of the <br />fire department and shall report directly to the city <br />manager. <br /> <br />ARTICLE II. POLICE DEPARTMENT <br /> <br />Sec. 21-5. Appointment of members. <br /> <br />(a) All law enforcement officers employed within the <br />police department shall be appointed in the manner <br />as provided in Article 1269m, Texas Revised Civil <br />Statutes; provided, however, nothing herein shall <br />be construed so as to include the chief of police <br />who performs as the head of such department within <br />such appointment procedures, other than those <br />provided in section 21-1 of this chapter and Section <br />15 of Article 1269m. <br /> <br />(b) There shall be as many members of the police depart- <br />ment as the city council shall deem fit and proper, <br />and as authorized pursuant to section 2-31 of this <br />Code dealing with police and fire civil service. <br />
