James <br /> <br />Also Present: Jeff Watkins, Ted Breihan, John Kreczmer, Terry <br />Roberts, Sharyl Werner, Joe Garza, Jerri Martin, Dusty Rhodes, <br />Wayne Moore, Bobby Hargroder, Andrew Gary, Jim Byrn and others. <br /> <br />The Mayor called the meeting to order at 7:30 p.m. <br /> <br />The Mayor introduced for consideration completion of Victory Gardens <br />Phase I Project. The City Manager reported that staff had discovered <br />an area in the intersection of Roosevelt and Patton Streets where <br />the base was measured at about 4" as opposed to the 8" specified <br />in the contract with Du-Mor Enterprises. Mr. Gonzalez told the <br />Council that subsequent tests had been made and the results showed <br />several areas where the base depth varied from the specifications. <br />After discussion with the contractor, it appeared that City staff <br />inspectors and engineer had directed the contractor to decrease the <br />amount of base in certain areas for two reasons. The first problem <br />was encountered when utility lines were too close to the surface <br />of the street to build it as planned. City staff raised the elevations <br />rather than going to the expense of lowering lines and delaying the <br />project. After the base was laid, drainage problems appeared in <br />certain areas. To cope with this, base was cut back so that the <br />street would drain adequately. An engineer had been consulted and <br />staff recommended that additional asphalt could be laid in the problem <br />areas discovered this week. The additional asphalt would compensate <br />for the lesser amounts of base material. Mr. Gonzalez also informed <br />the Council that City records were insufficient to document the <br />assumptions described earlier regarding the utility lines and drainage <br />problems. He asked the Council to give some direction to the City <br />staff. A discussion followed between the Council Members and the <br />City Manager. Mrs. Norris made a motion to direct the contractor," <br />to hire a testing laborato~y acceptable to the City to test the quality <br />of the road as it is as compared to what was required in the contract. <br />Mr. Stokes seconded the motion. Mr. Tenorio moved to amend the <br />original motion to request that the testing laboratory provide <br />alternatives if the road is not to standard. Mr. Stokes seconded <br />the motion. On the amendment to the motion, the vote was unanimous <br />for approval. On the original motion, the vote was unanimous for <br />approval. <br /> <br />The Mayor then introduced for consideration a Resolution having the <br />following caption: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING AN AGREEMENT PERTAINING TO THE CONSTRUCTION OF A <br />SANITARY SEWER SYSTEM TO SERVE SAN MARCOS BAPTIST ACADEMY; <br />AUTHORIZING THE MAYOR OF SAID CITY EXECUTE SAID AGREEMENT AND <br />ESTABLISHING AN EFFECTIVE DATE. <br /> <br />Mr. Cavazos moved to adopt the Resolution. Mrs. Norris stated that <br />she had received several phone calls from citizens opposed to the <br />City being required to pay a portion of the utility relocation which <br />might be necessary in the future due to the potential widening of <br />Ranch Road 12. Mr. Tenorio said he had received phone calls also. <br />Mr. Tenorio moved to table the Resolution. Mrs. Norris seconded the <br />
