I I I 12 ORDINANCE NO. 1980- 23 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING CHAP- TER 14, ENTITLED "HOUSING CODE" OF THE CODE OF ORDINANCES OF SAID CITY BY ADOPT- ING THE 1979 EDITION OF THE "STANDARD HOUSING CODE" AND THE 1980 REVISIONS TO SAID CODE WHICH ESTABLISH MINIMUM STAN- DARDS FOR OCCUPANCY OF BUILDINGS USED, DESIGNED OR INTENDED TO BE USED FOR HUMAN HABITATION WITHIN THE CORPORATE LIMITS OF SAID CITYjAJlliNDING SAID CODE TO INCREASE REQUIRED SPACE IN A DWELLING UNIT AND TO PROVIDE A PENALTY FOR VIOLATIONS AND DE- CLARING AN EMERGENCY. WHEREAS, the City Council of the City of San Marcos, Texas desires to ensure that the basic minimum housing standards deemed essential for safe and healthful living are required within the corporate limits of the City of San Marcos, Texasj now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TE XAS : SECTION 1. That Chapter 14, Entitled "Housing Code", of the Code of Ordinances, City of San Marcos, Texas is hereby amended to read as follows: Section 14-1. Adopted There is hereby adopted by the City of San Marcos, Texas, for the purpose of providing the basic minimum housing standards deemed essential for safe and healthful living and the minimum requirements necessary to maintain any residential occupancy in a safe and sanitary condition within the corporate limits of the City of San Marcos, Texas, that certain housing code known as the "Standard Housing Code", 1979 Edition, and the 1980 Revisions to said Code, published by the Southern Building Code Congress International Inc., 900 Montclair Road, Birmingham, Alabama 35213, now and as hereinafter amended, of which a copy has been and now is filed in the office of the City Secretary of the City of San Marcos, and the same is hereby adopted and incorporated as fully as if set out herein. Section 14-2. provisions Controlling The provisions of the Standard Housing Code shall be controlling within the corporate limits of the City of San Marcos, Texas as to minimum standards for occupancy of all buildings or por- tions thereof used, designed or intended to be used, for human habitation regardless of when such building may have been constructed. Section 14-3. Amendments to housing code The said 1979 edition of the Standard HOusing Code and the 1980 Revisions thereto, are amended and changed in the following respects and the amended sections~ Section 108 and Section 306.l,-~h&11_re~d as follows:
