<br />I <br /> <br />I <br /> <br />I <br /> <br />12 <br /> <br />ORDINANCE NO. 1980- 23 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, AMENDING CHAP- <br />TER 14, ENTITLED "HOUSING CODE" OF THE <br />CODE OF ORDINANCES OF SAID CITY BY ADOPT- <br />ING THE 1979 EDITION OF THE "STANDARD <br />HOUSING CODE" AND THE 1980 REVISIONS TO <br />SAID CODE WHICH ESTABLISH MINIMUM STAN- <br />DARDS FOR OCCUPANCY OF BUILDINGS USED, <br />DESIGNED OR INTENDED TO BE USED FOR HUMAN <br />HABITATION WITHIN THE CORPORATE LIMITS OF <br />SAID CITYjAJlliNDING SAID CODE TO INCREASE <br />REQUIRED SPACE IN A DWELLING UNIT AND TO <br />PROVIDE A PENALTY FOR VIOLATIONS AND DE- <br />CLARING AN EMERGENCY. <br /> <br />WHEREAS, the City Council of the City of San Marcos, Texas <br />desires to ensure that the basic minimum housing standards deemed <br />essential for safe and healthful living are required within the <br />corporate limits of the City of San Marcos, Texasj now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TE XAS : <br /> <br />SECTION 1. That Chapter 14, Entitled "Housing Code", of the <br />Code of Ordinances, City of San Marcos, Texas is hereby amended <br />to read as follows: <br /> <br />Section 14-1. Adopted <br /> <br />There is hereby adopted by the City of San <br />Marcos, Texas, for the purpose of providing the <br />basic minimum housing standards deemed essential <br />for safe and healthful living and the minimum <br />requirements necessary to maintain any residential <br />occupancy in a safe and sanitary condition within <br />the corporate limits of the City of San Marcos, <br />Texas, that certain housing code known as the <br />"Standard Housing Code", 1979 Edition, and the <br />1980 Revisions to said Code, published by the <br />Southern Building Code Congress International Inc., <br />900 Montclair Road, Birmingham, Alabama 35213, now <br />and as hereinafter amended, of which a copy has <br />been and now is filed in the office of the City <br />Secretary of the City of San Marcos, and the same <br />is hereby adopted and incorporated as fully as if <br />set out herein. <br /> <br />Section 14-2. provisions Controlling <br /> <br />The provisions of the Standard Housing Code <br />shall be controlling within the corporate limits <br />of the City of San Marcos, Texas as to minimum <br />standards for occupancy of all buildings or por- <br />tions thereof used, designed or intended to be <br />used, for human habitation regardless of when <br />such building may have been constructed. <br /> <br />Section 14-3. Amendments to housing code <br /> <br />The said 1979 edition of the Standard HOusing <br />Code and the 1980 Revisions thereto, are amended <br />and changed in the following respects and the amended <br />sections~ Section 108 and Section 306.l,-~h&11_re~d <br />as follows: <br />
