125 RESOLUTION 1998- 2~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS OF AMENDMENT TWO THE LEASE AGREEMENT BETWEEN THE CITY AND THE GREATER SAN MARCOS YOUTH COUNCIL; RESCINDING AMENDMENT NUMBER ONE TO THIS LEASE AGREEMENT; WAIVING ALL BUILDING PERMIT AND IMPACT FEES; AUTHORIZING THE CITY MANAGER TO EXECUTE THE AMENDMENT, AND DECLARING AN EFFECTIVE DATE. RECITALS: 1. On August 25, 1997 the San Marcos City Council approved an Amendment One to a Lease Agreement between the City and the Greater San Marcos Youth Council ("Youth Council"). This amendment was for City property located directly behind their current building for the purposes of constructing a family resource center. 2. On November 10,1997, the Youth Council requested that they be allowed to lease the property in front of their current building in place of the property approved by the City Council on August 25, 1997. 3. The City is willing to lease the additional space to the Greater San Marcos Youth Council under the terms and conditions of the Amendment Two to the Lease Agreement attached to this resolution. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. The terms and conditions of the attached Amendment Two to Lease Agreement between the City and the Greater San Marcos Youth Council, are approved. PART 2. All building, impact fees and other fees in connection with construction performed by or on behalf of the Greater San Marcos Youth Council on the tract of property covered by Amendment Two are waived. PART 3. Amendment One which was approved by the City Council on August 25, 1997 is rescinded and canceled. PART 4. The City Manager, Larry D. Gilley, is authorized to execute Amendment Two. PART 5.
