<br />~ <br />0'"' <br /> <br /> <br />20. <br /> <br /> <br /> <br />>-15 <br />~~ <br />00 <br /> <br />ORDINANCE 1998- 9 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING <br />MAP OF THE CITY BY REZONING A 32.36 ACRE TRACT OF <br />PROPERTY LOCATED AT TERMINUS OF LEAH AVENUE <br />NEAR CENTRAL TEXAS MEDICAL CENTER AS FOLLOWS: <br />TRACT 1: 16.78 ACRES FROM "DP-2" TWO-FAMILY <br />DWELLING DISTRICT (MEDIUM DENSITY), "MF-4" MUL TI- <br />FAMILY DISTRICT (HIGH DENSITY) AND "C" COMMERCIAL <br />DISTRICT TO "MF-2" MULTI-FAMILY DISTRICT (MEDIUM <br />DENSITY); TRACT 2: 5.52 ACRES FROM "DP-2" TWO- <br />FAMILY DWELLING DISTRICT (MEDIUM DENSITY) AND "C" <br />COMMERCIAL DISTRICT TO "MF-3" MULTI-FAMILY <br />DISTRICT (HIGH DENSITY); TRACT 3: 5.08 ACRES FROM <br />"DP-2" TWO-FAMILY DWELLING DISTRICT (MEDIUM <br />DENSITY), "MF-3" MULTI-FAMILY DISTRICT (HIGH <br />DENSITY) AND "C" COMMERCIAL DISTRICT TO "C" <br />COMMERCIAL DISTRICT; AND TRACT 4: 4.98 ACRES- A <br />RECONFIGURATION OF THE BOUNDARIES OF A TRACT <br />ZONED AS "MF-3" MULTI-FAMILY DISTRICT (HIGH <br />DENSITY); INCLUDING PROCEDURAL PROVISIONS; AND <br />PROVIDING FOR PENALTIES. <br /> <br />RECITALS: <br /> <br />1. On January 13, 1998 , the Planning and Zoning Commission of the City of San <br />Marcos held a public hearing regarding a request to change the zoning of Tract 1: 16.78 <br />acres from "DP-2" Two-Family Dwelling District (Medium Density), "MF-4" Multi-Family <br />District (High Density) and "C" Commercial District to "MF-2" Multi-Family District (Medium <br />Density); Tract 2: 5.52 acres from "DP-2" Two-Family (Medium Density) and "C" <br />Commercial District to "MF-3" Multi-Family District (High Density); Tract 3: 5.08 acres from <br />"DP-2" Two-Family Dwelling District (Medium Density), "MF-3" Multi-Family District (High <br />Density) and "C" Commercial District to "C" Commercial District and Tract 4: 4.98 acres- <br />a reconfiguration of the boundaries of a tract zoned as "MF-3" Multi-Family District (High <br />Density), comprising a total of 32.36 acres of property located at the terminus of Leah <br />Avenue near Central Texas Medical Center. <br /> <br />2. Subsequent to the public hearing on that date, the Planning and Zoning <br />Commission did, on January 13, 1998 consider and vote to approve the request, and has <br />recommended that the request be approved by the City Council of the City. <br /> <br />3. The City Council held a public hearing on the 23rd day of <br />February , 1998, regarding the request. <br /> <br />4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining <br />to zoning map amendments have been met. <br /> <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 <br />of the San Marcos City Code, is amended to rezone the following real property which is <br />presently zoned "DP-2" Two-Family Dwelling District (Medium Density), "MF-4" Multi- <br />Family District (High Density) and "C" Commercial District to "MF-2" Multi-family District <br />(Medium Density): <br /> <br />Street address: <br /> <br />Terminus of Leah Avenue near Central Texas Medical Center <br />
