<br />ORDINANCE NO. 2007-~ <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE <br />CITY TO ESTABLISH THE ZONING FOR A 119.165 ACRE, MORE OR <br />LESS, TRACT OF PROPERTY LOCATED IN TRACT 88 OF THE JUAN M. <br />VERAMENDI SURVEY NO.1, FRONTING THE 2500-2800 BLOCKS OF IH- <br />35 SOUTH AS "PDD" PLANNED DEVELOPMENT DISTRICT, WITH BASE <br />ZONING OF "GC" GENERAL COMMERCIAL DISTRICT (113.133 ACRES, <br />MORE OR LESS), "MU" MIXED USE DISTRICT (6.032 ACRES, MORE OR <br />LESS); APPROVING A LAND USE PLAN AND DEVELOPMENT <br />STANDARDS FOR THE STONE CREEK CROSSING PDD; INCLUDING <br />PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. <br /> <br />RECITALS: <br /> <br />1. On January 23,2007, and January 29,2007, the Planning and Zoning Commission of <br />the City of San Marcos held public hearings regarding a request to establish the zoning for a <br />119.165 acre, more or less, tract of property located in Tract 88 of the Juan M. Veramendi <br />Survey No.1, fronting the 2500 - 2800 blocks of IH-35 South as "PDD" Planned Development <br />District, with base zoning of "GC" General Commercial District (113.133 acres, more or less), <br />and "MU" Mixed Use District (6.032 acres, more or less), to be known as the Stone Creek <br />Crossing Planned Development District. <br /> <br />2. Subsequent to the second public hearing on that date, the Planning and Zoning <br />Commission did, on January 29, 2007, consider and vote to approve the request, and has <br />recommended that the request be approved by the City Council of the City. <br /> <br />3. The City Council held a public hearing on March 20,2007, regarding the request. <br /> <br />4. All requirements of Chapter 4, Zoning, of the San Marcos Land Development Code <br />pertaining to zoning map amendments have been met. <br /> <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The Official Zoning Map of the City, as described in Chapter 4, Article 1, <br />Division 2 of the San Marcos Land Development Code, is amended to establish the zoning for <br />the following two tracts of real property (collectively, the "Project Site"), which are not presently <br />subject to a zoning district, as "PDD" Planned Development District, with base zoning as <br />described below for the respective tracts comprising the Project Site, subject to the provisions of <br />the land use plan and development standards described in Section 2 of this ordinance: <br />
