<br />r ~~ 9; ~ ~ 95 <br />.p":'Q) <r ;:S~ <br />" ¡,.J ë3 -:.. w ...":: <br />'1.\1 ;g ..:~ 5 c: <br />~:o ~ ~~ <br />¡Nt co P' <br />~.;t\ ~ E ~ <br /> <br />~~ ¥;ðÇ, ORDINANCE 1998 - 15 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, PROVIDING FOR IMMOBILIZING AND IMPOUNDMENT <br />OF VEHICLES WITH THREE OR MORE UNPAID PARKING VIOLATIONS <br />BY AMENDING ARTICLE 4, STOPPING, STANDING, PARKING OF <br />CHAPTER 82, TRAFFIC AND VEHICLES, OF THE SAN MARCOS CITY <br />CODE; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR <br />PENAL TIES. <br /> <br />RECITALS <br /> <br />1. The City has received numerous complaints about the lack of available parking in <br />the downtown area. In addition to the limited number of parking spaces, stricter <br />enforcement of parking ordinances was identified as a method of increasing <br />parking availability. <br /> <br />2. The San Marcos Police Department intends to automate the enforcement of <br />parking violations to enable the parking technician to identify those vehicles with <br />numerous outstanding parking citations for "booting," which immobilizes the <br />vehicle, requiring the owner or operator to address the citations prior to regaining <br />use. of the vehicle. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />SECTION 1. Chapter 82, Article 4, Section 82.159 of the San Marcos City Code <br />is amended as follows (underlinina indicates added text): <br /> <br />Sec. 82.159. Penalties for parking violations. <br /> <br />@} A person who violates this Article shall be guilty of a misdemeanor and upon <br />conviction shall be subject to a fine of not less than the following: <br /> <br />(1) Parking overtime: <br /> <br />a. If paid within three days $ 5.00 <br />b. After three days 20.00 <br /> <br />(2) Improper parking 10.00 <br /> <br />(3) Parking in a restricted zone 15.00 <br /> <br />(4) Double parking 4.00 <br /> <br />(5) Parking in a lane of traffic 30.00 <br /> <br />Leaving less than 14 feet for <br />the free movement of vehicles 30.00 <br /> <br />(6) Parking on left side of street: <br /> <br />a. Business district 20.00 <br />b. Residential district 10.00 <br /> <br />(7) Blocking traffic or driveway: <br /> <br />a. Business district 10.00 <br />b. Residential district 4.00 <br />
