FOR SEVERABILITY, REPEALING ALL CONFLICTING c( <:.;¡~ ORDINANCES; PROVIDING A PENALTY; PROVIDING FOR' PUBLICATION AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That Article III of Chapter 10, Fire Prevention and Protection, of the San Marcos Code of Ordinances is amended to read as follows: ARTICLE III. FIRE PREVENTION CODE Sec. 10-38. Adopted. The Standard Fire Prevention Code, 1994 Edition along with appendices B, C and D published by the Southern Building Code Congress International, Inc. is adopted. A copy of this code with appendices is filed in'the City Secretary's office, Sec. 10-39. Violations declared nuisances: extraterritorial application. All violations of this article which pose a serious danger to the safety of persons or property are declared nuisances and are prohibited within the City limits and outside the City limits for a distance of 5,000 feet. Sec. 10-40. Definitions. In this article: Applicable governing body means the city council. Board of Adjustments and Appeals means the construction board of adjustments and appeals èstablished in Chapter 5. Building Code means the Building Code adopted in Chapter 5, Fire official means the fire marshal. Mechanical Code means the Mechanical Code adopted in Chapter 5, Plumbing Code means the Plumbing Code adopted in Chapter 5. Sec. 10-41. Amendments. The fire prevention code adopted in Sec, 10-38 is amended as follows: (1) Section 101.4 is deleted. (2), Section 102.2 is deleted. (3) Section 105,1 is de,leted.. u -
