<br />-.~ ~J <br />01; ~ 177 <br />l1Ji "t5 _-t- ìj <br />1': ~~ <br />_I' 2: c,;;)..... <br />IQ..~ ~~ ORDINANCE 1995- 14 <br /> ~5 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br /> SAN MARCOS, TEXAS, REVISING AND UPDATING <br /> ARTICLE I OF CHAPTER 18, PARKS AND RECREATION, OF <br /> THE SAN MARCOS CODE OF ORDINANCES; PROVIDING <br /> REGULATIONS FOR THE PLA YSCAPE AREA OF <br /> CHILDREN'S PARK; INCLUDING PROCEDURAL' <br />-- PROVISIONS; AND PROVIDING PENALTIES FOR <br /> VIOLATIONS. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> SECTION 1, That Article I of Chapter 18, Parks and Recreation, of the San Marcos <br /> Code of Ordinances is amended to read as follows: <br /> ARTICLE I. IN GENERAL <br /> Sec. 18-1. Definitions. <br /> In this Chapter: <br /> , <br /> (1) Department means the parks and recreation department. <br /> (2) Director means the director of the parks and recreation department. <br /> (3) Children's Park means an area bounded on the North by the driveway <br /> leading from Cheatham Street to the Children's Park parking areas, <br /> on the East by the San Marcos River, on the South by the Union <br /> Pacific Railroad tracks, and on the West by Purgatory Creek, <br /> (4) Playscape area of Children's Park means an area in Children's Park <br /> bordered by timbers enclosing the community playscape. <br /> (5) Motor vehicle has the meaning given in the State Uniform Act <br /> Regulating Traffic on Highways. <br /> (6) City park means any area of real property owned, used or maintained <br /> by the city as a public park, playground, or athletic facility. <br /> Sec. 18-2. Night curfew in city parks. <br /> (a) It is unlawful for any person to enter or remain in any city park <br /> between the hours of 11 :00 p.m. and 6:00 a.m. <br /> (b) It is a defense to prosecution that the person is either participating in <br /> a supervised program approved by the director, or fishing along the San Marcos <br /> River. <br /> (c) Application for approval for a supervised program must be submitted <br />i to the director of parks and recreation at least 24 hours before the program is to <br /> begin on a form provided by the director. <br />i, <br /> Sec. 18-3. Prohibiting disruptive conduct. <br /> It is unlawful for any person to interfere with, disrupt, or prevent the orderly <br /> conc! ,Ict of any program being conducted by the department in any city park, <br /> building or swimming pool. <br />
