<br />
<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
<br />OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL
<br />ZONING MAP OF THE CITY BY REZONING 0.82 ACRES
<br />OF PROPERTY, LOCATED AT 408 S. GUADALUPE.
<br />STREET FROM "I" INDUSTRIAL DISTRICT TO "LI"
<br />LIGHT INDUSTRIAL DISTRICT AND DECLARING AN
<br />EFFECTIVE DATE.
<br />
<br />WHEREAS, on November 30, 1993, the zoning Commission of the
<br />city of San Marcos held a public hearing regarding a request to
<br />change the zoning from "I" Industrial District to "LI" Light
<br />Industrial District for 0.82 acres of property located at 408 S.
<br />Guadalupe stfeet; and,
<br />
<br />WHEREAS, subsequent to the public hearing on that date, the
<br />Zoning commission did, on November 30, 1993 consider the request
<br />and voted to approve it and has recommended that the request be
<br />approved by the city Council of the City; and,
<br />
<br />WHEREAS, the city council held a public hearing on the '24th
<br />day of January, 1994, regarding the request; and,
<br />
<br />WHEREAS, all requirements of Appendix A, General zoning
<br />Ordinance, of the Code of Ordinances of the city of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, the city Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the
<br />public health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS,
<br />TEXAS: '

<br />SECTION 1., That the Official zoning Map of the city, as
<br />described in section 3 of the General zoning Ordinance, is hereby
<br />amended to rezone the following described real property located at
<br />408 S. Guadalupe Street, San Marcos, Hays County, Texas, which is
<br />presently zoned "I" Industrial District ,to "LI" Light Industrial
<br />District:

<br />BEING A PORTION OF THAT 2.19 ACRE TRACT OF LAND DESCRIBED
<br />AS "FIRST TRACT" AS CONVEYED TO WILLIAM K. JACKSON, ET
<br />AL, BY BERNIE BOWDEN, ET AL, BY DEED DATED APRIL 21,
<br />1980, AND RECORDED IN VOLUME 341, PAGE 50, HAYS COUNTY
<br />DEED RECORDS, AND BEING MORE PARTICULARLY DESCRIBED BY
<br />METES AND BOUNDS AS FOLLOWS, TO-WIT:

<br />BEGINNING at the most Northerly corner of the said
<br />Jackson 2.19 acre tract, for the most Northerly corner of
<br />the tract herein described, same, being at the
<br />intersection of the West line of, Guadalupe Street with
<br />the Southeast line of the'M.K.&T. Railroad;
<br />
<br />THENCE, leaving the said M.K.&T. Railroad, with the West
<br />line of the said Guadalupe Street, S 08030' E, 124.07
<br />feet to the most Northerly' corner of that 0.649 acre
<br />tract of land conveyed to Fred Hoffman Sons by William K.
<br />Jackson, et aI, by deed dated March 6,1981', and recorded
<br />in Volume 354, Page 527, Hays County Deed Records, for
