Që;5 ORDINANCE OF THE CODE OF ORDINANCES OF THE CITY BY <br /> AMENDING SECTION 35 (G) AND (H) REGARDING SPECIFIC <br /> USE PERMITS FOR ON-PREMISE CONSUMPTION OF ALCOHOLIC <br /> BEVERAGES; PROVIDING FOR SEVERABILITY; REPEALING <br /> ALL CONFLICTING ORDINANCES; PROVIDING A PENALTY; <br /> PROVIDING FOR PUBLICATION; AND PROVIDING AN <br /> EFFECTIVE DATE. <br /> WHEREAS, on June l, 1993, the Zoning Commission of the <br /> City of San Marcos (the "Commission") held a public hearing <br /> to consider amendments to Section 35(G) (2) and Section 35 (H) <br /> (3) (d & f) of the General Zoning Ordinance with regard to <br /> the renewal and revocation of TABC specific use permits for <br /> on-premise consumption of alcoholic beverages; and, <br /> WHEREAS, subsequent to that public hearing, the <br /> Commission voted to table consideration of the amendments; <br /> and¡ <br /> . <br /> WHEREAS, on August 3¡ 1993, the Commission held a public <br /> hearing to consider amendments to the following sections of <br /> the General Zoning Ordinance: Section 35 (G) (2) and Section <br /> 35(H) (3) (a & g) with regard to to TABC specific use permit <br /> procedures for authorizing on-premise consumption of <br /> alcoholic beverages; and, <br /> wHEREAS, subsequent to that public hearing¡ the <br /> Commission considered the amendments and voted to approve the <br /> amendments and has recommended that the amendments be <br /> approved by the City Council; and, I <br /> WHEREAS, on October 5, 1993, the Commission held a <br /> public hearing to reconsider previous recommendations to City <br /> Council and to amend Section 35 (H) (3) of the General Zoning <br /> Ordinance with regard to TABC specific use permits for <br /> on-premise consumption of alcoholic beverages; and, <br /> WHEREAS, subsequent to that public hearing, the <br /> Commission considered the amendments and voted to approve the <br /> amendments and has recommended that the amendments be <br /> approved by the City Council; and, <br /> WHEREAS¡ the City Council hereby finds and determines <br /> that the adoption of the following amendments is In the <br /> interest of the public health¡ morals, welfare¡ and safety; <br /> now, therefore, <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS¡ TEXAS: <br /> SECTION 1. That Section 35(G) (2), of Appendix A, General <br /> Zoning Ordinance, of the San Marcos Code of Ordinances is <br /> amended with regard to the period of specific use and renewal <br /> of TABC permits to read as follows: <br /> (2) TABC permits: Specific use permits granted <br /> for on-premise consumption of alcoholic <br /> beverages shall remaln In effect for the <br /> duration of the State TABC license until the <br /> license is cancelled¡ revoked, or allowed to <br /> expire, or until one of the conditions listed <br /> below occurs, after which the dispensing of <br />
