S C:;:' <br /> <br />75 <br /> <br />ORDINANCE 1994- 14 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, AMENDING APPENDIX C- <br />SUBDIVISIONS OF THE SAN MARCOS CODE OF <br />ORDINANCES BY REVISING THE DEFINITION OF <br />SUBDIVISION, AND ADDING A RESTRICTION ON THE. <br />DEPTH OF LOTS AND BY MAKING OTHER CLARIFYING <br />REVISIONS; PROVIDING FOR SEVERABILITY; <br />REPEALING ALL CONFLICTING ORDINANCES; <br />PROVIDING A PENALTY; PROVIDING FOR <br />PUBLICATION, AND PROVIDING AN EFFECTIVE DATE. <br /> <br />RECITALS <br /> <br />1. The Planning commission has conducted a public hearing and <br />has recommended that certain amendments be made to the following <br />sections of Appendix C- Subdivisions of the San Marcos Code of <br />Ordinances: <br /> <br />Art. II, <br />Art. V, <br />Art. VI, <br />Art. VI, <br />Art. VI, <br />Art. VII, <br /> <br />Sec. B. <br />Sec. E. <br />Sec. D. <br />Sec. E. <br />Sec. H. <br />Sec. E. <br /> <br />Definitions of specific terms; <br />Final plat, construction plans; <br />Sidewalks; ~ <br />Sidewalk construction; <br />Lots; and <br />Sidewalk construction <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That the definitions numbered 44 and 49 in Section <br />B of Article II of Appendix C- Subdivisions of the San Marcos Code <br />of Ordinances are amended to read as follows: <br /> <br />, <br />44. Sidewalk: A paved pedestrian way generally located <br />within public street right-of-way, but outside the <br />roadway. <br /> <br />49. Subdivision includes: <br /> <br />a. The following when done for the present or future <br />purpose of sale or building development: <br /> <br />1. The division of any tract of land into 2 or <br />more tracts or lots; or <br /> <br />2. The assembly of 2 or more tracts of land into <br />1 tract or lot. <br /> <br />b. The following changes to a recorded subdivision <br />plat: <br /> <br />1. A resubdivision of all or part of the <br />SUbdivision; <br /> <br />2. Any change of lot size or lot lines; or <br /> <br />3. The relocation of any street. <br /> <br />c. The platting of a previously unplatted tract of <br />land encompassing 1 or more lotso <br /> <br />Subdivision does not include the division or assembly <br />of tracts of land for the production of agricultural <br />products outside of a building. <br /> <br />SECTION 2. That Section E.l.e. (13) of Article V of Appendix <br />C- Subdivisions of the San Marcos Code of Ordinances is amended to <br />read as follows: <br />
