<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
<br />OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL
<br />ZONING MAP OF THE CITY BY ZONING 4.875 ACRES,
<br />MORE OR LESS, OF LAND AREA IN THE J.M.~
<br />VERAMENDI LEAGUE NO. 2 IN SAN MARCOS, HAYS
<br />COUNTY, TEXAS, BEING THAT 3.63 ACRE TRACT OF
<br />LAND DESCRIBED IN A DEED FROM W.C. CARSON,
<br />TRUSTEE, TO SCRUTCHIN PROPERTIES, INC. DATED
<br />JANUARY 10, 1980 AND RECORDED IN VOLUME 337,
<br />PAGE 253 OF THE HAYS COUNTY DEED RECORDS AND
<br />BEING THOSE TWO TRACTS OF LAND DESCRIBED IN A
<br />DEED FROM P.H. RHEW, TO SCRUTCHIN PROPERTIES,
<br />INC. DATED MARCH 7, 1980 AND RECORDED IN
<br />VOLUME 339, PAGE 326 OF THE HAYS COUNTY DEED
<br />RECORDS, LOCATED ON THE SOUTHWEST SIDE OF THE
<br />400 BLOCK OF RIVERSIDE DRIVE FROM "C"
<br />COMNERCIAL DISTRICT TO "P" PUBLIC AND
<br />INSTITUTIONAL DISTRICT AND DECLARING AN
<br />EFFECTIVE DATE.

<br /> WHEREAS, on October 27, 1992, the Joint Planning and Zoning
<br />Commissions of the City of San Marcos held a public hearing
<br />regarding a request to change the zoning from "C" Commercial
<br />District to "P" Public and Institutional District of 4.875 acres,
<br />more or less, of land area in the J.M. Veramendi League No. 2 in
<br />San Marcos, Hays County, Texas, being that 3.63 acre tract of land
<br />described in a deed from W.C. Carson, Trustee, to Scrutchin
<br />Properties, Inc. dated January 10, 1980 and recorded in Volume 337,
<br />Page 253 of the Hays County Deed Records and being those two tracts
<br />of land described in a. deed from P.H. Rhew, to Scrutchin
<br />Properties, Inc. dated March 7, 1980 and recorded in Volume 339,
<br />Page 326 of the Hays County Deed Records,~ located on the Southwest
<br />Side of the 400.Block of Riverside' Drive; and,
<br />
<br /> WHEREAS, subsequent to the public..hearing on that date, the
<br />Zoning Commission did, on October 27, !992~consider the request and
<br />voted to approve it and .has recommended that' the request be
<br />approved by the'City Councit'of the City; and,
<br />
<br /> WHEREAS, the city Council held a public hea~ing on the l!th
<br />day of January , ~1993, regarding the request; and,
<br />
<br /> WHEREAS, all requirements of Appendix A,. General Zoning
<br />Ordinance, of the Code~ of Ordinances of .the City of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br /> WHEREAS, the City Council hereby finds and de~ermines that the
<br />adoption of the following ordinance is in the interest of the
<br />public health, m0rals,-welfare and safety; now, therefore,
<br />
<br /> BE IT ORDAINED BY THE'cITy COUNCIL'OF THE CiTY OF SAN MARCOS,
<br />TEXAS:

<br /> SECTION 1. That the Offi~iat Zoning Map of'the city, as
<br />described in Section 3.of...the General Zoning ordinance is hereby
<br />amended to rezone the following described real pr6perty located in
<br />San Marcos, Hays County, .Texas, .which. is preSently zoned "C"
<br />Commercial District to "P"' Public and'.Institutional District:
