RESOLUTION 1993 - 16 R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MA_RCOS, TEXAS AUTHORIZING INITIATION OF CONDEMNATION PROCEEDINGS AGAINST HARRY T. BUGGE, JR. TO ACQUIRE 0.365 OF ONE ACRE OF LAND IN CONNECTION WITH THE RIVER ROAD IMPROVEMENTS IN THE CITY OF SAN MARCOS, TEXAS; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of San Marcos, Texas has determined that the River Road improvements are required for the preservation of the public health, safety and welfare and the public convenience and necessity in the City of San Marcos, Texas; and, WHEREAS, the necessary improvements require acquisition by the City of San Marcos of 0.365 of one acre of land currently owned by Harry T. Bugge, Jr., the 0.365 of one acre of land being more fully described in Exhibit A attached hereto and incorporated herein for all purposes; and, WHEREAS, the City of San Marcos has previously attempted to negotiate in good faith for the purchase of said property, 'and, WHEREAS, the City of San Marcos has been unable to acquire this property by purchase notwithstanding said negotiations; now, therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. That the 0.365 of one acre of land more fully described in Exhibit A attached hereto and incorporated herein for all intents and purposes is necessary and essential for the completion of the River Road improvements in the City of San Marcos, Texas. PART 2. That the River Road improvements are required for the preservation of the public health, safety and welfare and the public convenience and necessity. PART 3. That the City Attorney, Mark B. Taylor is hereby authorized to cause the initiation of condemnation proceedings for the acquisition of said property. PART 4. That this Resolution shall be in full force and effect immediately from and after its passage. ADOPTED this the 26thday of January , 1993. Mayor Attest: Ja~is K. Womack City Secretary
