<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
<br />OF SAN MARCOS, TEXAS DECLARING THE NECESSITY
<br />OF ACQUIRING CERTAIN PROPERTY WITHIN THE COR-
<br />PORATE LIMITS OF SAID CITY FOR A PUBLIC PUR-
<br />POSE; DESCRIBING THE PROJECT FOR WHICH SAID
<br />PROPERTY IS TO BE ACQUIRED; DESCRIBING SAID
<br />PROPERTY; AUTHORIZING CITY ATTORNEY TO INSTI-
<br />TUTE CONDEMNATION PROCEEDINGS AND DECLARING
<br />AN EFFECTIVE DATE.
<br />
<br />WHEREAS, there exists a need to reconstruct and widen the
<br />portion of Railroad Street located between the Missouri-Pacific
<br />Railroad tracks and Purgatory Street, said portion located within
<br />the corporate limits of the City of San Marcos, Texas; and,
<br />
<br />WHEREAS, such reconstruction and widening of said portion
<br />would be of benefit to the public because said portion is currently
<br />too narrow and in an inadequate state of repair to accommodate the
<br />present level of traffic on said portion; and,
<br />
<br />WHEREAS, there exists the need for said city to acquire addi-
<br />tional right-of-way to complete said reconstruction and widening;
<br />and,
<br />
<br />WHEREAS, the City of San Marcos, Texas, has, by authority of
<br />Art. 1, §17 of the Texas Constitution and Art. 3264 et ~., TEXAS
<br />REVISED CIVIL STATUTES, the right of eminent domain; and
<br />
<br />WHEREAS, said City through diligent effort has been unable to
<br />determine the ownership of Lot One (1), Block Two (2) of the Dan
<br />McKie First Addition to the City of San Marcos, Texas; and,
<br />
<br />WHEREAS, it is necessary for said city to condemn a fifteen
<br />(15) foot by one hundred sixty seven (167) foot strip of Lot ONe
<br />(1), Block Two (2) of said Dan McKie First Addition, said strip
<br />abutting Railroad Street; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS,
<br />TEXAS:
<br />
<br />SECTION 1. That a portion of Lot One (1), Block Two (2)
<br />of the Dan McKie First Addition, an addition to the City of San
<br />Marcos, Hays County, Texas, according to the map or plat there-
<br />of, recorded in Volume "X", Page 547, Hays County Deed Records,
<br />said portion being a strip of land fifteen (15) feet by one hundred
<br />sixty seven (167) feet abutting Railroad Street, said portion being
<br />described more particularly as follows:
<br />
<br />Commencing at a point, said point being the intersec-
<br />tion of the Southwest street line of Railroad Street
<br />and the Southeast street line of Purgatory Street,
<br />said point also being the most Northerly corner of
<br />Lot 1, Block 2, of the Dan McKie Addition to the City
<br />of San Marcos, and the starting point of this descrip-
<br />tion.

<br />Thence, S 54°-30'E, along the Southwest street line
<br />of Railroad Street, a distance of 166.67' to a point,
<br />said point being the most Easterly corner of the here-
<br />in described property, and also marks the intersection
<br />of the Southwest street line of Railroad Street and
<br />the Northwest R.O.W. line of the Missouri-Pacific
<br />Railroad.

<br />Thence, S 35°-30'W, along the Northwest R.O.W. line
<br />of the Missouri-Pacific Railroad a distance of 15.00'
<br />to a point, said point marks the most Southerly corner
<br />of the herein described property.
