8 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, MARCH 14, 1983 PRESENT: Mayor Emmie Craddock Council Members Karl W. Brown Gerald G. Farr John A. Mayor Craddock called the meeting to order at 7:30 p.m. Mayor Craddock introduced for consideration approval of the minutes of the Regular Meeting held February 28, 1983. Mr. Brown moved for approv- al of the minutes and Mr. Farr seconded the motion, which passed unani- mously. Mayor Craddock introduced for consideration approval of an Ordinance on first reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, GRANTING TO TRANSPORTATION ENTERPRISES, INCORPORATED, A FRANCHISE FOR FIFTEEN (15) YEARS TO OPERATE AND MAINTAIN A MOTOR BUS SYSTEM FOR THE TRANS- PORTATION OF PERSONS AND PROPERTY UPON THE PUBLIC STREETS AND HIGHWAYS OF THE CITY OF SAN MARCOS, TEXAS, PURSUANT TO THE PROVISIONS OF THE CONSTITUTION AND LAWS OF THE STATE OF TEXAS, THE CHARTER OF THE CITY OF SAN MARCOS, AND THE CODES AND ORDINANCES OF THE CITY OF SAN MARCOS; SETTING TERMS AND CONDITIONS FOR THE OPERATION OF SAID TRANSPORTATION ENTERPRISE AND DECLAR- ING AN EFFECTIVE DATE. Mrs. Norris moved to approve the Ordinance on first reading and Mr. Moore seconded the motion. Mr. Brown moved to amend the Ordinance in Section l(B) for a term of five years instead of fifteen years and in Section ICE) to set the rate at 2% of gross sales, which section would read as follows: "Payments to City. City shall not require of Company the payment of any fees, licenses or charges other than those required by the statutes of the State of Texas; the regularly levied and assessed taxes on its property located in the City of San Marcos; a street rental charge consisting of 2 percent of all gross receipts of the Company on operations with- in the City of San Marcos serving the City and/or Southwest Texas State University. II Mrs. Norris seconded the motion, which passed unanimously. The Council then voted unanimously for approval of the Ordinance on first reading, as amended.
