<br />- <br /> <br />~ 78 <br /> <br />- <br /> <br />:"::.~ <br />ORDINANCE 1991-2 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, ORDERING A JOINT GENERAL <br />AND SPECIAL ELECTION BY THE CITY AND THE SAN <br />MARCOS CONSOLIDATED INDEPENDENT SCHOOL <br />DISTRICT TO BE HELD IN THE CITY OF SAN MARCOS, <br />TEXAS ON MAY 4, 1991 FOR THE PURPOSE OF <br />ELECTING A CITY COUNCIL MEMBER, PLACE FIVE, <br />AND A CITY COUNCIL MEMBER, PLACE SIX, AND FOR <br />THE PURPOSE OF SUBMITTING TO THE VOTERS A <br />PROPOSAL TO ALLOW THE CONSTRUCTION OF A PUBLIC <br />LIBRARY ON CERTAIN PARK PROPERTY; AND TO BE <br />HELD WITHIN THE BOUNDARIES OF SAID SCHOOL <br />DISTRICT FOR THE PURPOSE OF ELECTING A SCHOOL <br />DISTRICT BOARD OF TRUSTEES MEMBER, PLACE ONE, <br />A SCHOOL DISTRICT BOARD OF TRUSTEE MEMBER <br />PLACE TWO; ESTABLISHING THE RATE OF <br />COMPENSATION TO BE PAID JUDGES, CLERKS, AND <br />ASSISTANTS TO THE TABULATION SUPERVISOR FOR <br />SERVICES RENDERED DURING THE ELECTION; MAKING <br />PROVISIONS FOR THE CONDUCT OF THE ELECTION AND <br />OTHER PROVISIONS INCIDENT TO THE PURPOSES OF <br />THIS ORDINANCE; AND DECLARING AN EMERGENCY. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That, in accordance with the Charter of the <br />City of San Marcos and the laws of the State of Texas, so far as <br />the same may be applicable, a joint general and special election <br />is ordered to be held by the City of San Marcos, Texas and the San <br />Marcos Consolidated Independent School District, at the various <br />polling places and election precincts within the corporate limits <br />of the City of San Marcos, Texas, and within the boundaries of the <br />San Marcos Consolidated Independent School District, as <br />hereinafter designated, on the 4th day of May, 1991, from the <br />hours of 7:00 a.m. to 7:00 p.m., at which joint election there <br />shall be elected by the qualified voters of the City of San Marcos <br />from the City at large, a City Council Member for Place Five and <br />a City Council Member for Place Six, for terms of three years <br />each, and at which joint election there shall be submitted to the <br />qualified voters of the City a proposal to allow for the <br />construction of a public library on certain park property. By the <br />qualified voters of the San Marcos Consolidated Independent School <br />District there shall be elected a School District Board of <br />Trustees Member for Place One, and a School District Board of <br />Trustees Member for Place Two, for terms of three years each. <br /> <br />SECTION 2. That, in accordance with Section 9.ØØ4 of the <br />Texas Local Government Code, and Section 3.Ø7(a)of the City <br />Charter, and with other applicable laws, the following measure <br />shall be submitted to the qualified voters of the City at the <br />election to be held May 4, 1991: <br /> <br />MEASURE NO. ONE <br />SHALL THE CITY REDEDICATE FOR CONSTRUCTION AND OPERATION OF A <br />CITY LIBRARY AND FOR PARK PURPOSES A TRACT OF LAND UP TO 3.5 <br />ACRES IN SIZE OUT OF A 25 ACRE, MORE OR LESS, TRACT OF <br />CITY-OWNED LAND LOCATED ACROSS HOPKINS STREET FROM CITY HALL <br />AND BORDERED BY EAST HOPKINS STREET, 'WEST BUGG LANE, AND <br />RAILROAD RIGHT-OF-WAY. <br /> <br />SECTION 3. That the ballots for the election called <br />hereunder shall conform to the requirements of the Texas Election <br />Code, and shall have the measure described herein stated as a <br />proposition on such ballots as follows: <br /> <br />proposition No.1 <br /> <br />FOR/AGAINST To rededicate for the construction and operation of <br />a city library and for park purposes a tract of <br />land up to 3.5 acres in size out of a 25 acre, more <br />or less, tract of city-owned land located across <br />Hopkins Street from City Hall and bordered by East <br />Hopkins Street, West Bugg Lane, and railroad <br />right-of-way. <br />
