<br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
<br /> OF SAN MARCOS, TEXAS, CANVASSING RETURNS AND
<br /> DECLARING THE RESULTS OF THE GENERAL AND
<br /> SPECIAL ELECTION HELD ON MAY 4, 1991 FOR THE
<br /> PURPOSE OF ELECTING A CITY COUNCIL MEMBER,
<br /> PLACE FIVE AND A CITY COUNCIL MEMBER, PLACE
<br /> SIX AND FOR THE PURPOSE OF SUBMITTING TO THE
<br /> VOTERS A PROPOSITION TO ALLOW THE CONSTRUCTION
<br /> OF A PUBLI C LIBRARY ON CERTAIN PARK PROPERTY7
<br /> AND DECLARING AN EMERGENCY.
<br /> WHEREAS, the City Council of the City of San Marcos,
<br /> Texas, by ordinance duly enacted on February 11, 1991 ordered
<br /> that a Special and General election be held on May 4, 1991
<br /> for the purpose of electing a City Council member, place five
<br /> and a City Council member, place six, and submitting to the
<br /> voters a proposition to allow the construction of a public
<br /> library on certain park property 7 and,
<br /> WHEREAS, notice of this election was duly published in
<br /> the San Marcos Daily Record on April 7, and April 14, 19917
<br /> and,
<br /> WHEREAS, copies of this notice were duly posted at each
<br /> city election precinct polling place prior to the election,
<br /> and a copy of same was posted on the City Hall bulletin board
<br /> on or before March 21, 19917 and,
<br /> WHEREAS, the election was duly and legally held on the
<br /> 4th day of May, 1991, in conformity with the election laws of
<br /> the State of Texas, and the results of the election have been
<br /> certified and returned by the proper judges and clerks
<br /> thereof 7 and,
<br /> WHEREAS, the City Council of the City of San marcos,
<br /> Texas with the following members present: Billy G. Moore,
<br /> Rick Hernandez ,Ronald K. Hart ,Kathy M. Morris ,
<br /> Fred Guerra ,Betty Jane K~ssler, and B~ll Plummer has
<br /> today considered the returns of the Special and General
<br /> election held on the 4th day of May, 19917 and,
<br /> WHEREAS, it appears to the Council, and the Council so
<br /> finds, that the election was in all respects lawfully held7
<br /> and,
<br /> 'tvHEREAS, it appears to the Council and Council so finds
<br /> that the tabulation of the results of the election is
<br /> correct7 now, therefore,
<br /> BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY
<br /> OF SAN MARC OS , TEXAS:
<br /> SECTION l. That the Special and General City election
<br /> of May 4, 1991 was duly called, that notice of the election
<br /> was given in accordance with law, and that the election was
<br /> held in accordance with law.
<br /> SECTION 2. That the tabulation of votes cast in the
<br /> Special and General election held on May 4, 1991 for the
<br /> purpose of electing a City Council member, place five and a
<br /> City Council member, place six, and submitting to the voters
<br /> a proposition to allow the construction of a public library
<br /> on certain park property, made and certified to by the City
<br /> Secretary of the City of San Marcos, a copy of which is
