<br />~ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
<br />SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF
<br />THE CITY BY ZONING AN 8.56 ACRE TRACT OF LAND OUT OF THE
<br />J. M. VERAMENDI LEAGUE NO.2, HAYS COUNTY, TEXAS, BEING A
<br />PORTION OF THAT 9.83 ACRE TRACT OF LAND CONVEYED TO L.O.
<br />BACKUS BY QUAD THEATRE COMPANY, A TEXAS CORPORATION, BY
<br />DEED DATED JANUARY 15, 1979, AND RECORDED IN VOLUME 321,
<br />PAGE 95, HAYS COUNTY DEED RECORDS, LOCATED AT 1125 HIGH-
<br />WAY 80 FROM "PD" (PRE-DEVELOPMENT DISTRICT) TO IIC"
<br />(COMMERCIAL DISTRICT) AND DECLARING AN EFFECTIVE DATE.

<br />
<br />WHEREAS, on January 2,1990, the Zoning Commission of the City of
<br />San Marcos held a public hearing regarding a request to change
<br />the zoning from "PD" (Pre-Development District) to IIC" (Commercial
<br />District) for 8.56 acres of land out of the J.M. Veramendi
<br />Leauge No.2, Hays County, Texas; 10cated at 1125 Highway 80, San
<br />Marcos, Texas; and,
<br />
<br />WHEREAS, subsequent to the public hearing on that date, the
<br />Zoning Commission did, on January 2,1990, consider the request and
<br />voted to approve the same and has recommended that such
<br />request be approved by the City Council of the
<br />City; and,
<br />
<br />WHEREAS, the City Council held a public hearing on the 9th day
<br />of April, 1990, regarding such request; and,
<br />
<br />WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, the City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the public
<br />health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS:
<br />
<br />SECTION 1. That the Official Zoning Map of the City, as
<br />described in Section 3 of the General Zoning Ordinance, is hereby
<br />amended to rezone the following tract of real property located in San
<br />Marcos, Hays County, Texas, which was zoned "PD" (Pre-Development
<br />District) upon its annexation to the City of San Marcos on November
<br />24,1980, to IIC" (Commercial District):

<br />DATED JANUARY 15, 1979, AND RECORDED IN VOLUME 321, PAGE 95,
<br />HAYS COUNTY DEED RECORDS, AND BEING MORE PARTICULARY DESCRIBED
<br />BY METES AND BOUNDS AS FOLLOWS, TO-WIT:
<br />
<br />BEGINNING at an iron stake at the east corner of the tract
<br />herein described, same being on the southeast line of the said
<br />Backus 9.783 acre tract, the northwest line of River Road (Hays
<br />County Road No. 299), and being the most southerly corner of
<br />Slamco Subdivision, a subdivision of record in Book 3, Page 32,
<br />Hays County Plat Records;
<br />
<br />THENCE, with the southeast line of the said Backus 9.783 acre
<br />tract, the northwest line of the said River Road, the following
<br />courses numbered (1) and (2):
<br />
<br />(1) S 45 00' W, 300.53 feet to an iron stake;
<br />(2) S 44 49' W, at about 4 feet passing an overhead power line
<br />and continuing on, in all, 184.59 feet to a concrete highway
<br />monument, for an easterly southeast corner of the tract herein
<br />described;
