<br />RESOLUTION 1989-9R <br /> <br />35 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, APPROVING THE TERMS AND <br />CONDITIONS OF LEASE AMENDMENT NUMBER THREE TO <br />THAT LEASE AGREEMENT DATED SEPTEMBER 9, 1980 <br />BETWEEN SAID CITY AND GT+3 FLIGHT OPERATIONS, <br />INC.; AUTHORIZING THE MAYOR OF SAID CITY TO <br />EXECUTE SAID LEASE AMENDMENT ON BEHALF OF SAID <br />CITY: AND, DECLARING AN EFFECTIVE DATE. <br /> <br />WHEREAS, the City of San Marcos has entered into a lease <br />agreement dated September 9, 1980 with GT+3 Flight Operations <br />for the lease of certain property located at the San Marcos <br />Municipal Airport for use in the conduct of its business as a <br />Fixed Based Operator at said airport: and, <br /> <br />WHEREAS, the City of San Marcos, Texas desires to <br />construct a new airport terminal building on the site of the <br />premises leased in said lease agreement in order to reduce <br />construction costs by using the existing foundation, utility <br />connections and other fixtures: and, <br /> <br />WHEREAS, GT+3 Flight Operations must be relocated to <br />temporary facilities during the construction of said terminal <br />building: and, <br /> <br />WHEREAS, said City and GT+3 Flight Operations desire to <br />permanently relocate GT+3 Flight Operations within said <br />terminal building upon its completion; and, <br /> <br />WHEREAS, the terms and conditions of Lease Amendment <br />Number Three, which is attached hereto as Exhibit II A" and <br />incorporated herein for all purposes, have been approved by <br />the San Marcos Airport Commission: now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br /> <br />PART 1. That the recitals written above in the <br />preamble to this resolution are hereby adopted as true and <br />correct and incorporated herein in their entirety. <br /> <br />PART 2. Tha t the terms and condi tions of Lease <br />Amendment Number Three to that agreement between GT+3 Flight <br />Operations and the City of San Marcos, which is attached <br />hereto and incorporated herein for all purposes be and are <br />hereby approved. <br /> <br />PART 3. That the Mayor of the City of San Marcos, <br />Texas, Kathy M. Morris, be and is hereby authorized to <br />execute said Lease Amendment on behalf of said City. <br /> <br />PART 4.
