<br /> 137 <br />4,£,) <br /> ORDINANCE 1989-10 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />-~f MARCOS, TEXAS, AMENDING APPENDIX A-GENERAL ZONING <br /> ORDINANCE OF THE CODE OF ORDINANCES OF SAID CITY BY <br /> ADDING A DEFINITION FOR BED AND BREAKFAST INN; <br /> MODIFYING THE DEFINITION OF HOME OCCUPATION; UPDATING <br /> THE LIST OF ZONING DISTRICTS DESIGNATED; CHANGING THE <br /> ZERO LOT-LINE DWELLING DISTRICT DESIGNATION FROM ZL-l <br /> TO ZL; DELETING SUBSECTION 25(D)-M SINGLE-FAMILY, <br /> DUPLEX AND NEIGHBORHOOD BUSINESS DISTRICT; ADDING "P" <br /> AS THE LETTER DESIGNATION FOR THE PUBLIC AND <br /> ~INSTITUTIONAL DISTRICT IN SECTION 26; ADDING "BED AND <br /> BREAKFAST INN" AS A PERMITTED USE IN A COMMERCIAL <br /> DISTRICT; DELETING A DUPLICATE PROVISION IN SECTION <br /> 32(B)-LIGHT INDUSTRIAL DISTRICT; RENUMBERING THE <br /> REMAINING PARAGRAPHS IN SECTION 32(B) IN PROPER <br /> SEQUENCE; ADDING A NEW SET OF SPECIFIC USE PERMIT <br /> CONDITIONS FOR CHILD DAY CARE AND BED AND BREAKFAST <br /> INNS CONDUCTED AS HOME OCCUPATIONS; MODIFYING SECTION <br /> 36-SUPPLEMENTAL AREA REQUIREMENTS; SPECIFYING THAT <br /> STANDARDS FOR HANDICAPPED PARKING SPACES BE CONSISTENT <br /> WITH THOSE CONTAINED IN THE BUILDING CODE; ADDING A NEW <br /> STANDARD REQUIRING LANDSCAP ING AND TREES WITHIN THE <br /> PERIMETER OF THE PAVED AREA OF CERTAIN PARKING LOTS; <br /> MODIFYING A PROVISION ALLOWING SPECIAL EXCEPTIONS TO <br /> v\7A I VE OR RE DUC E PARKING AND LOADING REQUIREMENTS BY <br /> ADDING SPECIFIC STANDARDS; ADDING A CLARIFICATION THAT <br /> SPECIAL EXCEPTIONS FOR EXPANSION OF A PRE-EXISTING <br /> NONCONFORMING USE ARE SUBJECT TO COMPLIANCE WITH <br /> POLICI ES OF THE MASTER PLAN WITH REGARD TO LAND USE <br /> COMPATIBILITY; AND DECLARING AN EFFECTIVE DATE. <br /> WHEREAS, on November 1, 1988, the Zoning Commission of the City of <br />San Marcos held a public hearing to consider amendments to the <br />following sections of Appendix A- General zoning ordinance: Section 4- <br />definition of "Bed and Breakfast Inn"; Section 35, Specific Use <br />Permits; Section 37(B)(15), Off-Street Parking Design and Construction <br />Standards; and, <br /> WHEREAS, subsequent to said public hearing on said date; said <br />Commission did on November 1, 1988, consider said amendments and the <br />Zoning Commission voted to approve the same and has recommended that <br />said request be approved by the City Council of said City; and, <br /> v'iTHEREAS, on January 3, 1989, the Zoning Commission of the City of <br />San Marcos held a public hearing to consider amendments to the <br />following sections of Appendix A- General Zoning Ordinance: Section <br />4, definition of a home occupation; Section 5(B), New districts <br />designated; Section 18, Zero Lot Line Dwelling District (medium <br />densi ty); Section 25(D), Specific uses; Section 26, Public and <br />Institutional District; Section 30(A)(2) Commercial District- <br />Permitted uses; Section 32(B), Light Industrial District-Permitted <br />uses; Section 35(H)(1)(f) and (g) Specific Use Permits-Home <br />Occupations; Section 36(1), Supplemental Area Requirements; Section <br />37(A)(20.5) Off-Street Parking-Minimum Requirements; Section 37(B)(7), <br />Off-Street Parking- Design and Construction Standards; Section <br />37(B)(I)(c), Off-Street Parking-Handicapped parking spaces; Section <br />37(B)(15), Off-Street Parking-addition of provision for landscaping in <br />certain parking lots; Section 4l(C)(4)(b) Powers of the Board of <br />Adjusments-parking and loading requirements; Section 4l(C)(4)(e) Powers <br />of Board of Adjustments-compliance with policies of the Master Plan; <br />and, <br /> WHEREAS, subsequent to said public hearing on said date, said <br />Commission did, on January 3, 1989 consider said amendments and the <br />Zoning Commission voted to approve the same and has recommended that <br />said request be approved by the City Council of said Ci ty; and, <br />
