or against a potential Ordinance, amending Chapter 341 Article 5, Division 2 of the San <br />Marcos City Code by adding provisions to prohibit smoking in the enclosed areas of all <br />public places and workplaces, and provide direction to Staff. <br />Collette Jamison, Assistant City Manager, provided a brief presentation. <br />Mayor Daniel Guerrero opened the public hearing at 9:11 p.m. <br />Matt Nolan, CTMC, spoke in favor of the ban and stated the reasons for CTMC's own smoke <br />free campus and how he felt it would benefit the City. <br />Dr. Phil Huang, City of Austin Health Department, spoke in favor of the ban and provided data <br />regarding the impacts of the City of Austin's Ordinance on Austin businesses. <br />Joel Romo, American Heart Association, spoke in favor of the ban and respectfully asked the <br />Council to positively consider the adoption of an ordinance such as this. <br />Allen Manning, San Marcos, owner of the Triple Crown, spoke against the ban and provided <br />information to the Council about how it would negatively impact his business. He suggested a <br />grandfather clause. <br />Johnny Finch. San Marcos, owner of Chances R, and stated that smoking is still legal in this <br />country and asked what the hurry was on this item. He spoke against the ban and believed that <br />everyone seemed to have been invited to the "party" except the ones that it would negatively <br />affect the most. He feels this town is moving towards its own smoking ordinance and feels that <br />most people cannot accommodate an outright ban. <br />There being no comments; the public hearing was closed at 9:27p.m. <br />Council provided direction for Staff to formulate alternative wording of the draft ordinance to <br />further define "public place" to include outdoor seating areas of restaurants, bars and lounges, to <br />restrict smoking on the grounds or within a facility owned, leased or operated by the City, <br />(Inclusive of City office campuses), and that any phase in of the effective date of this ordinance <br />implementation may be set by Council. <br />Non Consent Agenda <br />32.Consider approval of Ordinance 2013 -54, on the first of two readings, adopting a budget <br />in the sum of $166,628,822 for the Fiscal Year beginning on October 1, 2013 and ending <br />on September 30, 2014; authorizing certain adjustments to the budget with the approval <br />of the City Manager; approving Fiscal Year 2013 -14 Capital Improvements Program <br />Proiects; including procedural provisions; and providing an effective date. <br />MOTION: Upon a motion made by Council Member Thomaides and a second by Council <br />Member Thomason, the City Council voted seven (7) for and none (0) opposed, to approve <br />Ordinance 2013 -54 on the first of two readings, with the following revisions to the budget: <br />
