<br /> 48 <br />Regular Meeting April 23, 1984 Page 3 <br />Mayor Craddock opened a public hearing to consider the annexation of <br />25.07 acres in the Robert Clever A-92 and Thomas H. W. Forsith A-173 <br />Surveys, the caption of the Ordinance which was read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, ANNEXING TO SAID CITY A TRACT OF LAND <br /> CONTAINING 25.07 ACRES OF LAND, MORE OR LESS, IN THE <br /> ROBERT CLEVER SURVEY, A-92, AND THE THOMAS H. FORSITH <br /> SURVEY, A-173, IN HAYS COUNTY, TEXAS, SAID LAND BEING <br /> LOCATED WITHIN THE EXTRATERRITORIAL JURISDICTION OF SAID <br /> CITY AND LYING ADJACENT TO PRESENT CITY BOUNDARIES; AP- <br /> PROVING A SERVICE PLAN FOR SAID TRACT; EXTENDING THE <br /> BOUNDARY LIMITS OF SAID CITY SO AS TO INCLUDE SAID <br /> TRACT; GRANTING TO THE INHABITANTS OF SAID TRACT ALL <br /> THE RIGHTS AND PRIVILEGES OF OTHER CITIZENS OF SAID <br /> CITY; BINDING SAID INHABITANTS BY ALL OF THE ACTS AND <br /> ORDINANCES, RULES AND REGULATIONS OF SAID CITY AND DE- <br /> CLARING AN EFFECTIVE DATE. <br />Mayor Craddock asked if anyone wished to speak in favor of the annexa- <br />tion. Tex Hughson, owner of the property, said this would be the last <br />phase in the Master Plan of his development. No one else wished to <br />speak in favor or in opposition to the annexation, so Mayor Craddock <br />closed the public hearing. <br />Mayor Craddock introduced for consideration approval of an Ordinance <br />on first reading, the caption which was read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, GRANTING TO THE SAN MARCOS BREAKFAST <br /> LIONS CLUB A FRANCHISE FOR THREE YEARS TO OPERATE <br /> AND MAINTAIN A TAXI SERVICE WITHIN THE CORPORATE <br /> LIMITS OF SAID CITY FOR THE PURPOSE OF TRNASPORTING <br /> PERSONS USING INNERTUBES ON THE SAN MARCOS RIVER; <br /> PRESCRIBING THE TERMS, CONDITIONS, OBLIGATIONS AND <br /> LIMITATIONS UPON WHICH SAID FRANCHISE SHALL BE EXER- <br /> CISED AND SETTING AN EFFECTIVE DATE. <br />Mr. Farr moved for approval of the Ordinance on first reading and Ms. <br />Kissler seconded the motion. Frank Rich of the Lions Club was present <br />to answer the Council's questions. The Mayor asked Mr. Rich for a break- <br />down of the funds going to charities. Mr. Rich indicated approximately <br />96% of the funds went to charities in San Marcos, such as Scheib, Hous- <br />ing Authority, the local Special Olympics, eyeglasses and eye care and <br />Southside Community Center. He said he would provide a breakdown to <br />the Council. He stated the other 4% goes to national and international <br />Lions, and their total collection is $7,000.00. Mr. Brown indicated <br />the park area surrounding the tube rental was cleaner of trash during <br />the use by the Lions Club than at other times of the year, and Mr. Farr <br />indicated the restroom maintenance was kept up better by the Lions as <br />well. Ms. Kissler asked if the River Taxi was inspected by the Police <br />Department annually or just at the beginning of the three-year franchise <br />agreement. Mr. Rich indicated it was inspected by the Police Department <br />just at the beginning of the franchise agreement and annually by State <br />Inspection. On roll call the following vote was recorded: <br /> AYE: Brown, Coddington, Farr, Craddock, Kissler, Moore. <br /> NAY: None. <br /> ABSTAIN: Guerra. <br />Mr. Guerra abstained because he is a member of the San Marcos Breakfast <br />Lions Club. <br />
