<br />-14- <br /> <br />Sec. 9-6. <br /> <br />Penalties and suspensions. <br /> <br />(a) The Electrical Inspector shall make <br />thorough inspection of all electrical work <br />installed in the City of San Marcos and shall <br />enforce all the provisions of this chapter by <br />entering any building or premises, after <br />presentation of proper credentials to the owner or <br />other person in control of the building or <br />premises, at reasonable times, and where electrical <br />work is in a dangerous or unsafe conditon, or is <br />deemed to be an interference with the work of the <br />Fire Department, the Electrical Inspector shall <br />notify the person owning, using, or operating the <br />electrical work to place it in a safe, secure and <br />non-interfering condition. Any person failing, <br />neglecting, or refusing within a reasonable time, <br />as determined by the Electrical Inspector and as <br />provided in the written notice, to make the <br />necessary repair or changes, shall be guilty of <br />violation of this chapter and every day which shall <br />elapse after the expiration of the reasonable time <br />as provided in th~ written notice until the wires <br />and apparatus are repaired, removed or changed as <br />required shall be considered a separate offense. <br /> <br />(b) Any person owning or in control of <br />premises covered by this chapter, and permitting <br />electrical work covered by this chapter to be <br />performed by any person not properly licensed shall <br />be guilty of violation of this chapter, and in <br />addition to other penalties assessed under the <br />General Provisions of the Codes of Ordinances of <br />the City of San Marcos shall immediately upon <br />notification by the Electrical Inspector cause all <br />offending work to be removed at the expense of the <br />person erecting or altering or allowing it. <br /> <br />(c) Any person who performs electrical work <br />covered by this chapter without a proper license <br />shall be guilty of violation of this chapter, and <br />in addition to other penalties assessed under the <br />General Provisions of the Code of Ordinances of the <br />City of San Marcos, shall be prohibited for a <br />period of ninety (90) days from the last date of <br />the offense from applying for or being issued a <br />license for the performance of electrical work <br />within the City. <br /> <br />(d) It shall be unlawful for any person to <br />break, change, destroy, tear, mutilate, cover or <br />otherwise deface or injure any such official notice <br />or seal posted by the Electrical Inspector. <br /> <br />(e) Any person who violates any provision of <br />this Chapter shall be punished upon conviction in <br />Municipal Court, as provided in the General <br />provisions of the Code of Ordinances. Such <br />punishment shall be in addition to any other <br />penalty provided elsewhere in this Chapter or other <br />laws. <br /> <br />Sec. 9-6.1. Certain acts prohibited. <br /> <br />It shall be unlawful for any person to do any <br />of the following acts: <br /> <br />(a) To display or cause or permit to be <br />displayed or to have in one's possession any <br />license for the doing of any electrical work, <br />knowing it to be fictitous or to have been <br />cancelled, suspended, or altered. <br />
