<br />-16- <br /> <br />official records of the City and shall convey two <br />copies to the Electrical Board. If the board deems <br />the information sufficient to support further <br />action by the board, the board shall make an order <br />setting the charges in it for the hearing within 30 <br />working days of the date of the issuance of the <br />order at a specified time and place, and shall <br />cause a copy of its order and of the information to <br />be served upon the accused by registered mail not <br />less than ten days before the date appointed in the <br />order for the hearing. The accused may appear in <br />person, by an attorney licensed by the state Bar of <br />Texas or both or in person and with a lay <br />representative of his choice, at the time and place <br />designated in the order to answer the allegations. <br />All hearings shall be open to the public. The City <br />Attorney and the accused or his or her <br />representative shall be entitled to present <br />evidence and arguments at the hearing. If the <br />accused fails or refuses to appear, the board may <br />proceed to hear and determine the charges in his or <br />her absence. If the accused admits the truth of <br />the charges, or if upon a hearing of the charges <br />the board by vote of three or more members shall <br />find them to be true, it may enter an order <br />suspending the license of the electrician. The <br />board shall have the power I through its Chair or <br />secretary, to administer oaths and to compel the <br />attendance of witnesses before it by subpoena <br />issued over the signature of the chair. <br /> <br />(d) When the Electrical Board has completed <br />the hearing and made its de'cision it shall cause <br />one copy of its decision to be filed wi th the <br />electrical enforcement official, one copy with the <br />city secretary and shall cause a certified copy to <br />be forwarded to the accused. <br /> <br />Sec. 9-6.3. Automatic suspension. <br /> <br />(a) The license of any person shall be <br />automatically suspended upon final conviction in <br />Municipal Court of taking out a permit in the name <br />of a person authorized to do the electrical work <br />and then permitting a person not authorized by this <br />chapter to do the electrical work. <br /> <br />(b) The suspension provided for in this <br />section shall in the first instance be for a period <br />of three months. In the event any license shall be <br />suspended under the provisions of this section for <br />a second time, it shall be for a period of one <br />year. <br /> <br />(c) The suspension of any license shall be <br />automatically extended upon the licensee being <br />convicted of performing electrica1 work while his <br />or her license is suspended with the extended <br />period of suspension being for a like period as the <br />original suspension, and in addition to any other <br />penalty assessed, as provided in this chapter. <br /> <br />Sec. 9-6.4. Surrender and return of license. <br /> <br />Any license which has been suspended under <br />this chapter shall be surrendered to and be <br />retained by the enforcement official. At the end <br />of the period of suspension, in the absence of <br />further violations, the surrendered license shall <br />be returned to the licensee and shall be valid <br />under the provisions of this chapter; provided, <br />that if the period of suspension extends beyond <br />
