All electrical work done or installed for any purpose shall be and remain at all times fully subject to the ordinances of the City of San Marcos. Sec. 9-2. Electrical Board established. There is hereby established an electrical examining, licensing, supervisory, and appeals board within the City of San Marcos, Texas, to be known as the "City of San Marcos Electrical Board," (Electrical Board). Sec. 9-2.1 Members of the Electrical Board. (a) The Electrical Board shall consist of five (5) members, three of whom shall constitute a quorum. A sixth ex officio member shall be appointed by the Chief Building Official from his staff and shall have no voting rights. One member shall be a representative of the San Marcos Electrical utility nominated by the SMEU Board and approved by the City Council as provided below. Four (4) members shall be master electricians who are currently licensed as such by the City of San Marcos, and must have obtained their license through testing in the City of San Marcos. (b) The voting members of the Electrical Board shall be appointed by the City Council of the City of San Marcos, Texas. Each member shall serve for a period of two years from the effective date of appointment, such term being automatically extended until a replacement is appointed. The Electrical Board shall elect a Chair from its voting membership. (c) Voting members of the Electrical Board shall serve without compensation, and the City of San Marcos, Texas, shall provide insurance to cover any damage claims arising from the performance of their duties. Sec. 9-2.2. Powers and duties of the electrical board. (a) It shall be the duty of the Electrical Board to pass upon the qualifications of all persons engaged in business as Master Electricians, pursuant to the provisions of this ordinance; to authorize the issuance of licenses by the City Inspection Department; and, to suspend licenses pursuant to the provisions of this Chapter. (b) It shall be the duty of the Electrical Board to hear appeals and render decisions upon rulings by the City Electrical Inspector when required by this Chapter. In disposing of an appeal, the Electrical Board shall determine if the ruling is in accordance with the NEC and its adopted amendments. If the ruling is in conflict with the NEC, it shall be overturned and the City Electrical Inspector shall not enforce or implement it. If the ruling is deemed valid, the Board may grant a variance to the ordinance provided the equivalent objectives can be achieved by some alternate method or equipment which establishes and maintains effective safety. If the variance is not granted, the Electrical Board shall direct the offending party to remove or remedy the violation.
