<br />-2- <br /> <br />local amendments, the local amendments shall <br />prevail. All electrical work done or installed for <br />any purpose shall be and remain at all times fully <br />subject to the ordinances of the City of San <br />Marcos. <br /> <br />Sec. 9-2. <br /> <br />Electrical Board established. <br /> <br />There is hereby established an electrical <br />examining, licensing, supervisory, and appeals <br />board within the City of San Marcos, Texas, to be <br />known as the "City of San Marcos Electrical Board," <br />(Electrical Board). <br /> <br />Sec. 9-2.1 Members of the Electrical Board. <br /> <br />(a) The Electrical Board shall consist of <br />five (5) members, three of whom shall constitute a <br />quorum. A sixth ex officio member shall be <br />appointed by the Chief Building Official from his <br />staff and shall have no voting rights. One member <br />shall be a representative of the San Marcos <br />Electrical utility nominated by the SMEU Board and <br />approved by the City Council as provided below. <br />Four (4) members shall be master electricians who <br />are currently licensed as such by the City of San <br />Marcos, and must have obtained their license <br />through testing in the City of San Marcos. <br /> <br />(b) The voting members of the Electrical <br />Board shall be appointed by the City Council of the <br />City of San Marcos, Texas. Each member shall serve <br />for a period of two years from the effective date <br />of appointment, such term being automatically <br />extended until a replacement is appointed. The <br />Electrical Board shall elect a Chair from its <br />voting membership. <br /> <br />(c) Voting members of the Electrical Board <br />shall serve without compensation, and the City of <br />San Marcos, Texas, shall provide insurance to cover <br />any damage claims arising from the performance of <br />their duties. <br /> <br />Sec. 9-2.2. Powers and duties of the electrical <br />board. <br /> <br />(a) It shall be the duty of the Electrical <br />Board to pass upon the qualifications of all <br />persons engaged in business as Master Electricians, <br />pursuant to the provisions of this ordinance; to <br />authorize the issuance of licenses by the City <br />Inspection Department; and, to suspend licenses <br />pursuant to the provisions of this Chapter. <br /> <br />(b) It shall be the duty of the Electrical <br />Board to hear appeals and render decisions upon <br />rulings by the City Electrical Inspector when <br />required by this Chapter. In disposing of an <br />appeal, the Electrical Board shall determine if the <br />ruling is in accordance with the NEC and its <br />adopted amendments. If the ruling is in conflict <br />with the NEC, it shall be overturned and the City <br />Electrical Inspector shall not enforce or implement <br />it. If the ruling is deemed valid, the Board may <br />grant a variance to the ordinance provided the <br />equivalent objectives can be achieved by some <br />alternate method or equipment which establishes and <br />maintains effective safety. If the variance is not <br />granted, the Electrical Board shall direct the <br />offending party to remove or remedy the violation. <br />
