24. Consider an ordinance amending Chapter 2 of the San Marcos City Code to adopt a <br />new Division 21 of Article 3 to establish a Veteran's Affairs Advisory Committee; and <br />including procedural provisions; and consider ordinance on the first of two readings. • <br />MOTION: Upon a motion made by Councilmember Couch and a second by Councilmember <br />Thomaides, the City Council voted seven (7) for and none (0) opposed, to approve the ordinance <br />on the first reading. The motion carried unanimously. <br />25. Consider an ordinance amending Chapter 54, Miscellaneous Offenses, of the San <br />Marcos Citv Code by adding Article 4, Possession of Graffiti Implements; defining and <br />establishing restrictions on the possession of graffiti implements; establishing penalties for <br />the violation thereof, providing a savings clause; providing for the repeal of any conflicting <br />provisions; providing for publication; and providing an effective date; and consider <br />ordinance on first of two readings. <br />MOTION: Upon a motion made by Councilmember Terry and a second by Councilmember <br />Jones, the City Council voted seven (7) for and none (0) opposed, to table the ordinance until the <br />February 17 meeting. The motion carried unanimously. <br />26. Consider an ordinance amending the San Marcos Citv Code Section 66.031 to prohibit <br />the placement of bulky waste, construction waste, and vard debris on the curb for <br />collection sooner than the day prior to the day of a scheduled special collection, amending <br />Section 34.701 to define the terms Excessive Noise and Unruly Gathering; Amending <br />Section 34.702 to prohibit party hosts or guests from causing excessive noise, obstructing • <br />streets or drivewavs, engaging in or allowing alcoholic beverage law violations or <br />participating in or allowing an unruly gathering; prohibiting owners and managers of <br />apartment complexes from allowing common areas to be used as venues for unruly <br />gatherings; requiring notification of property owners and managers after two (2) verified <br />excessive noise complaints, host or guest responsibility violations, or unruly gatherings <br />have occurred within a sixty (60) day period; providing for agreements concerning future <br />abatement strategies; authorizing a fee of $100 for each Police response for repeated <br />violations; repealing Sections 34.090 through 34.096 of the San Marcos City Code; <br />providing for penalties; including procedural provisions and declaring an effective date; <br />and consider ordinance on the first of two readings. <br />MOTION: Upon a motion made by Councilmember Thomaides and a second by <br />Councilmember Bose, the City Council voted seven (7) for and none (0) opposed, to separate the <br />ordinance into two separate ordinances for: 1) bulky waste, and 2) Noise/Host Responsibility; <br />and to bring both back for discussion at a later meeting. The motion carried unanimously. <br />MOTION: Upon a motion made by Councilmember Bose and a second by Councilmember <br />Thomaides, the City Council voted seven (7) for and one (1) opposed, with Councilmember <br />Jones voting against, to table the ordinance to the next meeting.
